SAVE America Act gets new push as Supreme Court allows late mail ballots

Manny Republicans argue that this ruling damages trust in elections and highlight the need for legislative action.Senators like Mike Lee are urging the Senate to bypass filibusters and pass the legislation, which has stalled in the Senate due to insufficient support. The House Republican leadership has also threatened to block votes until the Senate acts. Critics, including GOP figures and supporters like Scott Presler, believe courts are insufficient to address election issues and emphasize that the upcoming 2026 elections could be affected by the current legislative impasse and court decisions. Trump has been vocal in urging GOP lawmakers to end their blockade of the voter ID bill.


Congressional Republicans are redoubling their support for the SAVE America Act, a bill that has left Washington in gridlock for months, after the Supreme Court ruled states can count mail-in ballots that arrive after Election Day.

The 5-4 decision in Watson v. Republican National Committee rejected a GOP-led push to end laws that permitted mailed ballots to arrive and be counted days after the election, provided they are postmarked by Election Day. The ruling was a blow to the White House, but Republican lawmakers say it also underscores the need to pass the SAVE America Act, which President Donald Trump has repeatedly called for.

“Congress exercised its constitutional authority to designate one federal Election Day—not election week, not election month,” Sen. Mike Lee (R-UT) wrote on X. “This unfortunate decision further undermines trust in American elections and underscores the urgency of legislative action to secure them.”

Lee has pushed Senate Majority Leader John Thune (R-SD) to skirt the filibuster and pass the SAVE America Act. The legislation, which would require voter ID to cast a ballot and proof of citizenship to register to vote nationwide, has stalled in the Senate because it does not have sufficient support to overcome the 60-vote threshold.

“We must get the Save America Act back to the floor for a vote,” Sen. Ashley Moody (R-FL) wrote on X. “The America (sic) people deserve to know who is standing up for this country.” 

Last week, House GOP leadership was forced to cancel votes as GOP rebels threatened to bring the floor to a standstill until the Senate passes the measure.

“The Left learned after the Supreme Court failed to stop the 2020 steal that they could weaponize mail-in ballots with zero consequences,” Rep. Abe Hamadeh (R-AZ) wrote on X. “The courts won’t save us—Congress must fill the void.”

GOP activist and influencer Scott Presler also slammed the court’s decision and suggested the ruling would be used to defeat Republicans up and down the ballot in 2026.

“You’re watching the 2026 election being stolen in real time, while our Senate does absolutely nothing,” Pressler wrote. “You should be furious.”
