California Governor Warns Against Book Bans in Schools

“Access to books – including books that reflect the diverse experiences and perspectives of Californians, and especially, those that may challenge us to grapple with uncomfortable truths – is a profound freedom we all must protect and cultivate.”

California Governor Gavin Newsom has issued a warning to schools in the state against removing materials from classrooms and libraries. In a letter to county and school district officials, Newsom emphasized the importance of protecting students’ access to books that reflect diverse experiences and perspectives, even if they may be controversial or uncomfortable.

Protecting First Amendment Rights

Newsom, along with Attorney General Rob Bonta and State Superintendent Tony Thurmond, cited several first amendment cases in their letter, including Tinker v. Des Moines Independent Community School District and McCarthy v. Fletcher. They emphasized that curricular decisions must be based on legitimate pedagogical interests and not an attempt at “rigid and exclusive indoctrination.”

The officials also stressed the importance of exposing students to various worldviews, stating that it is “vital” to their development. California Education Code requires local educational agencies to instruct students on the contributions of various ethnic and cultural groups to the development of California and the United States.

Consequences for Book Bans

If counties or districts are found to have removed materials, the attorney general’s office may request documentation, including policies regarding the First Amendment and freedom of speech, instructional materials and their assessments, and any communications related to removals. Newsom specifically called out Texas and Florida in his letter, where steps have been taken to restrict young students’ access to sexually explicit materials.

Protecting students’ access to diverse perspectives and ideas is crucial for their education and development. Let’s hope that schools in California and across the country continue to prioritize this fundamental freedom.
