Tuberville to Propose Bill Granting States Power to Sue DHS Over Border Security

Sen. Tommy Tuberville (R-Ala.) plans to introduce a bill that would require Homeland Security Secretary Alejandro Mayorkas to improve border security and allow state attorneys general to sue his department if it fails to do so.

Tuberville’s Office confirmed that Tuberville would introduce the measure (the Border Safety and Security Act) to The Epoch Times, March 8.

“Since President Biden took office, 4.8 million illegal immigrants—nearly equal to Alabama’s entire population—have entered our country,” Tuberville made the statement in a statement that was sent to The Epoch Times.

“The Biden administration refuses to secure our southern border, despite record numbers of deadly drugs, terrorist watch-listers, and other bad actors pouring into the U.S. unobstructed. Americans are tired of feeling unsafe in their communities and losing loved ones to drug overdoses.”

Two months after the expiration Title 42 expired, the introduction of Border Safety and Security Act is now. This order was used by the Trump and Biden administrations to expel some migrants from the southern border due to the COVID-19 epidemic.

Border Safety and Security Act (DHS Secretary) would allow the Department of Homeland Security to temporarily suspend illegal immigrant entry at the U.S. Border.

The secretary could take this measure if necessary to regain control over the border. The act also requires the secretary to stop illegal immigrants from entering the country during periods when DHS is unable to detain them or place them into Migrant Protection Protocols, or another similar program.

If the DHS secretary does not suspend entry, without detention or using MPP, the state attorneys general can take legal action. You can use the legal process to seek injunctive relief in court against DHS.

The proposed bill allows state attorneys general the right to bring legal action against DHS. This will help ensure the department meets its obligations.

According to Tuberville’s office, the senator is deeply worried about the threat that an open southern border provides to national security, particularly due to the flow of illicit drugs and concerns about entry by would-be terrorists.

After assuming control of the U.S. House, the Republicans sought to maintain the focus on the border crisis. A hearing will be held by the House oversight panel on March 8, to assess the need to provide additional resources to combat transnational crime along the border.

House Republicans led a group that traveled last month to Arizona’s border. House Democrats are planning a separate trip for later in this month.
