Trump’s Lawsuit Against New York Times Tossed Out by Supreme Court

The New York Supreme Court tossed out a lawsuit from former President Donald Trump against the New York Times on Wednesday.

New York Supreme Court Justice Robert Reed determined that Trump’s claims that the outlet had engaged in an “insidious plot” to obtain his personal records failed as a matter of “constitutional law.” He ordered the former president to pay all attorneys fees and legal expenses for the outlet.

Mary Trump, Donald Trump’s niece, was also a defendant in the case, but the suit specific to her has yet to be ruled on, according to the Daily Beast.

“The New York Times is pleased with the judge’s decision today,” a spokesperson for the New York Times told the Washington Examiner.

“It is an important precedent reaffirming that the press is protected when it engages in routine newsgathering to obtain information of vital importance to the public,” they added.

The lawsuit, which was filed by Donald Trump in 2021, accused Mary Trump of breaking a confidential agreement she signed in 2001 by smuggling personal documents out of her attorney’s office, which she then allegedly gave to the newspaper. Donald Trump also accused three New York Times reporters of acting with “actual malice” in publishing an article about his tax returns that went on to win a Pulitzer prize.

Reed ruled in his opinion Wednesday that Donald Trump failed to prove any tortious interference, unjust enrichment, or negligent supervision on the parts of the New York Times or its three reporters. Reed also said the reporters’ newsgathering was at “the very core of protected First Amendment activity.”

The ruling is the most recent in Donald Trump’s legal battles. He is facing a defamation lawsuit that includes an accusation from E. Jean Carroll that the former president raped her in the 1990s and a civil lawsuit against him and his company for fraud.

Donald Trump is additionally being investigated for possibly obstructing the investigation into how classified records wound up at his Mar-a-Lago resort in Palm Beach, Florida, and whether he influenced the Jan. 6 riot at the Capitol.

He also became the first president to face criminal charges after Manhattan District Attorney Alvin Bragg charged him with 34 criminal charges in relation to falsifying business records over alleged “hush money” payments. A grand jury recently indicted Donald Trump on the 34 charges, and he has pleaded not guilty to all of them.
