President Donald Trump took a shot at the Supreme Court on Tuesday by congratulating China and Chinese President Xi Jinping after the court decided to uphold a broad definition of birthright citizenship.
“I would like to congratulate President Xi, and the Great Country of China, on their massive Birthright Citizenship WIN!” Trump wrote on Truth Social.

The Supreme Court ruled, 6-3, that Trump’s executive order stipulating that children born to parents who are in the United States illegally or temporarily are not American citizens is unconstitutional under the 14th Amendment.
The Trump administration has criticized birthright citizenship for creating and contributing to so-called “birth tourism” through which pregnant foreign nationals travel to the U.S. to give birth, providing their child with American citizenship.
“It is unacceptable for foreign parents to use a U.S. tourist visa for the primary purpose of giving birth in the United States to obtain citizenship for the child,” the State Department wrote on X. “Those who abuse our immigration system through birth tourism may be ineligible for future visas or travel to the United States.”
Although Trump suggested Chinese foreign nationals have the most to gain from the Supreme Court’s decision, Pew Research Center data indicate about one-third of all children born to foreign-born mothers in the U.S. have mothers from Mexico. The next two most popular countries of origin are China and India, with 5% apiece.
Trump’s social media post was one of many on Tuesday in response to the Supreme Court’s decision, including one in which if he implored Congress to “easily” compensate for the “too bad” majority opinion “through Legislation.”

“No long and unwieldy Constitutional Amendment is necessary!” he wrote. “Congress should start TODAY to work on ending expensive and unfair to our Country, Birthright Citizenship. They will have my Complete and Total Support!”
The White House did not clarify to which legislation Trump was referring, with a constitutional amendment requiring a two-thirds vote in the House and Senate or two-thirds vote of the country’s state legislatures at a national convention. It would then have to be ratified by three-fourths of the states, either through those state legislatures or special ratification conventions.
