Trump Attorneys Move State Lawsuit to Federal Court
Attorneys for former President Donald Trump have taken a significant step in a complex legal battle by moving a lawsuit seeking to bar him from running for the White House from state to federal court. This move is expected to eventually reach the U.S. Supreme Court.
The initial lawsuit was filed by the liberal group Citizens for Responsibility and Ethics in Washington in Colorado state court. They argue that a Civil War-era clause, which prohibits higher office for those who engaged in “insurrection” after swearing an oath to the Constitution, prevents Trump from running for president in 2024.
Trump’s attorneys have now moved the case to federal court, stating that the challenge to Colorado’s ability to place Trump on the presidential ballot relies solely on the Fourteenth Amendment. They argue that federal question jurisdiction under Section 3 of the Fourteenth Amendment justifies the removal of the state court action.
The 14th Amendment addresses various aspects of citizenship and citizen rights.
This case by Citizens for Responsibility and Ethics is the first of many challenges expected to be filed in different states by the group and another liberal nonprofit called Free Speech for People.
While activists in other states have filed lawsuits representing themselves, legal observers believe that the more comprehensive complaints by these nonprofits are more likely to reach the nation’s highest court, which has never ruled on this particular clause.
Trump criticized the liberal organization on Friday, claiming that it is affiliated with his critics and people he clashed with during his presidency. He referred to the group as “TRUMP DERANGED CREW” on his social media network Truth Social and accused them of trying to disqualify him in a “ridiculous” and “unconstitutional” manner.
CREW intends to request a federal judge to return the case to state court and has asked for a speedy ruling before Colorado’s Republican primary ballot is finalized on Jan. 5.
