The traditional majority appeared prepared to defend the Mississippi legislation outlawing abortion after 15 days and effectively overturn Roe when the judges heard oral arguments in Dobbs v. Jackson Women’s Health Organization in December 2021. A document opinion reflecting the court’s position was to be written by Justice Samuel Alito and distributed to the justices for review and decision-making regarding whether they would or on or conflict.

Although judges have the power to change their stance and vote on decisions before and after an impression is made public, Biskupic claimed that when Alito’s draft judgment was leaked in May of last year, the judges who were leaning toward overturning Roe were adamant that they wouldn’t waver.

The conversation ended in May after Biskupic reported that the document opinion had been sent to the justices in February.

The court claimed it was unable to identify the person who made the draft mind public following months of investigation into the hole.
