GOP leader says impeachment of WI justice is highly unlikely
Republican Assembly Speaker Robin Vos: Impeachment of Liberal Justice Janet Protasiewicz Unlikely
Republicans Discuss Impeachment Amidst Redistricting Lawsuits
Republican Assembly Speaker Robin Vos, previously threatening to impeach Wisconsin’s new liberal Justice Janet Protasiewicz if she did not recuse herself from cases that could impact GOP-drawn legislative maps, now deems that possibility “super unlikely.”
For months, Republicans have contemplated impeaching Justice Protasiewicz after liberal groups filed redistricting lawsuits immediately following her swearing-in ceremony in August. This appointment shifted the conservative Wisconsin Supreme Court, which had remained unchanged for 15 years, to a 4-3 Democratic majority.
Democrats Face Potential Consequences of Their Actions
“Impeachment is one of the tools at our disposal, ready to be used whenever necessary,” Vos stated in an interview with the Associated Press. “However, I believe it is highly unlikely that we will resort to it.”
Vos did not completely dismiss the idea of impeachment, acknowledging the uncertainty of future events. “We cannot predict what might happen, right? There could be a scandal or unforeseen circumstances. Who knows?” he added.
Shortly after Justice Protasiewicz’s inauguration, State Republicans filed a motion to remove her from the two ongoing lawsuits. However, in October, Protasiewicz declared that she would not recuse herself from hearing these cases.
In a 48-page order, Protasiewicz explained her decision, stating, “In considering this motion, I have thoroughly examined the law and my own conscience to ensure a fair and impartial ruling. I have carefully reviewed the arguments presented by both parties, studied the facts, and analyzed relevant precedents. Ultimately, I have concluded that I must deny the recusal motion.”
Protasiewicz has been vocal about her opposition to the Republican-drawn districts, denouncing them as ”rigged” and advocating for their review during her campaign for the state’s Supreme Court.
The Supreme Court heard oral arguments in November regarding the redistricting lawsuit filed on August 2 by Law Forward, a coalition of law firms and voting rights advocacy groups. They requested that all 132 state lawmakers be subject to election, including those not scheduled for the 2024 ballot. A ruling from the highest court is expected imminently.

What alternative methods might Speaker Vos and other Republicans pursue to address their concerns about the ideological composition of the court, considering the potential risks and challenges associated with impeachment
D the balance of the Wisconsin Supreme Court towards the liberal side, prompting concerns among Republicans that it could result in biased rulings regarding the redrawing of legislative maps.
The Republican Party argued that Justice Protasiewicz should recuse herself from these redistricting cases due to her previous involvement with liberal advocacy groups and her openly expressed opinions on the matter. Failure to recuse herself, they argued, would suggest a lack of impartiality and compromise the integrity of the court’s decision-making process.
In response to this concern, Speaker Vos initially made the bold statement that impeachment could be on the table if Protasiewicz refused to recuse herself. However, in a recent statement, he expressed that impeachment was now “super unlikely” and seemed to imply that other strategies would be pursued instead.
The softening of Vos’s stance on impeachment might be seen as a strategic move on his part. Impeaching a justice, especially in the absence of clear evidence of misconduct, would be a politically risky maneuver. It could give the appearance of a partisan attack on a member of the judiciary, potentially undermining public trust in the Republican Party and the justice system as a whole.
With redistricting lawsuits being a contentious issue and likely to garner significant public attention, Speaker Vos and other Republicans will undoubtedly explore alternative methods to address their concerns. These methods could include arguments before the court itself, lobbying for legislative solutions, or seeking public support for their cause.
It is important to note that discussions of impeachment in this context are relatively unprecedented. Impeaching a justice solely based on their political ideology sets a troubling precedent, as it risks politicizing the judicial branch and eroding the principle of checks and balances in our democracy.
While it is natural for political parties to be concerned about the ideological composition of the courts, it is essential to ensure that any attempts to address these concerns are done in a manner that upholds the integrity and independence of the judiciary.
As the redistricting lawsuits continue to unfold, it remains to be seen how Speaker Vos and the Republican Party will navigate this complex legal and political landscape. The outcome of these cases will undoubtedly have significant implications for Wisconsin’s electoral future and the balance of power between the two major political parties.
Ultimately, it is crucial that any actions taken by Republican leaders, including Speaker Vos, prioritize the fair and impartial administration of justice over partisan interests. The integrity of the court and the public’s trust in its decisions should always remain at the forefront of the political discourse surrounding redistricting and the judiciary as a whole.
