Ninth Circuit halts court order for Trump to return National Guard control to Newsom – Washington Examiner

The Ninth Circuit Court of Appeals recently granted President Donald Trump a temporary victory regarding the deployment of the National Guard in California. this decision temporarily blocked a federal judge’s ruling that required Trump to return control of the National Guard troops in Los Angeles to Governor gavin Newsom. The troops were initially deployed to manage violent protests against ICE’s deportation efforts.

Governor newsom had previously sued the Trump administration, arguing that the president’s assumption of control over the National Guard exceeded his authority without the necesary consent from the state. U.S. District Judge Charles breyer had ruled earlier in the day that the deployment was illegal and in violation of the Tenth Amendment. Following the Ninth Circuit’s decision, the governor expressed satisfaction with the initial ruling, framing the events as a test of democracy.The appeals court’s administrative stay allows Trump to maintain control of the National Guard for a few more days while the case is further considered.


Ninth Circuit halts court order for Trump to return National Guard control to Newsom

The Ninth Circuit Court of Appeals granted President Donald Trump a victory late Thursday night regarding National Guard troop deployment in California.

The Appeals Court blocked a federal judge’s order from earlier in the day that required the president to cede control of the National Guard in Los Angeles, California, to Gov. Gavin Newsom. Trump deployed the troops to the area to help subdue the violent anti-ICE riots happening in the city in protest of the agency’s efforts to deport illegal immigrants.

Newsom sued the Trump administration earlier this week over the order, calling it a manufactured crisis. He also claimed that the president’s taking over control of the National Guard exceeded his “Title 10 authority, not only because the takeover occurred without the consent or input of the Governor, as federal law requires, but also because it was unwarranted.”

U.S. District Judge Charles Breyer ruled earlier in the day that the deployment was illegal because it exceeded the president’s authority and violated the Tenth Amendment.

The governor of California was pleased with Breyer’s ruling. 

“Today was really about a test of democracy, and today we passed the test,” said Newsom.
