New Jersey sued over law allowing non-citizens who never lived in state to vote
The Republican National Committee (RNC) has filed a lawsuit against New Jersey over a state law that permits non-citizens without residency to vote by leveraging overseas residency and relative addresses. The plaintiffs argue that this law exceeds constitutional authority, as the state constitution requires voters to have been residents for at least 30 days prior to an election. The lawsuit aims to declare the provisions unconstitutional, prevent the registration of non-residents and non-citizens, and remove ineligible voters from the rolls. The New Jersey Republican Party and candidate michael McGuire support the legal challenge, asserting that the law allows individuals who have never lived in New Jersey to participate in elections, which they claim undermines election integrity. This legal action is part of the RNC’s broader effort to challenge similar voting laws across other states, building on recent victories such as a North Carolina ruling that barred “never-residents” from voting. The defendants in this case include state election officials and departments. The lawsuit seeks to protect lawful voter participation and uphold election laws by ensuring only eligible residents and citizens vote in New Jersey elections.

The lawsuit is part of the RNC’s broader strategy to challenge similar voting laws in other states, including Nebraska and Colorado. The party committee cited its victory in a recent North Carolina voting lawsuit.
