Leftists Target 35-Year-Old Female Judge Who Blocked Mask Mandate, Comment On Age

Leftists online were not pleased with U.S. District Judge Kathryn Kimball Mizelle for voiding the Biden administration’s mask mandate on public transportation on Monday.

The Trump-appointed federal judge called the mandate “unlawful” and vacated the requirement, writing, “Because our system does not permit agencies to act unlawfully even in pursuit of desirable ends, the court declares unlawful and vacates the mask mandate.”

Immediately, leftists complained Mizelle, 35, was unqualified for her position and commented on her age.

Rolling Stone ran with the headline, “Trump-Appointed Judge Deemed ‘Not Qualified’ by Bar Association Voids Mask Mandate on Planes, Other Travel.”

Notably, the ABA, or American Bar Association, has routinely been accused of having an extreme liberal bias.

Podcast host Brian Tyler Cohen posted a photo of Mizelle and echoed that she was unqualified for her position, complaining that Republicans “confirmed her anyway.”

“This is Kathryn Kimball Mizelle. She is a Federalist Society judge who worked for Clarence Thomas. The American Bar Association said she is unqualified to hold office, but Republicans confirmed her anyway after Trump lost,” he wrote. “She just ruled the CDC can’t require masks on planes.”

Ron Filipkowski, who claims to “track and report” on Right-wing media, posted a photo of the judge with Associate Supreme Court Justice Clarence Thomas, seemingly as a complaint.

“Judge Kathryn Kimball Mizelle, who overturned airplane mask mandate today, with mentor,” he captioned the post.

“Since 1989, the American Bar Association has assessed federal judicial nominees for consideration by the Senate. Of the 1,400 or so nominees assessed, just 22 have been rated ‘not qualified,’” said Left-wing activist Charlotte Clymer. “Kathryn Kimball Mizelle, who just struck down the flight mask mandate, is one of them.”

“I honestly think there’s a lot of room for respectful disagreement and discussion between rational adults on where and when to wear a mask, but not when it comes to commercial air travel,” Clymer added. “You’re around 200 strangers in a tight, enclosed space for hours. It’s common sense.”

Mizelle’s age seemed to be an issue, too. “FYI, the Florida federal judge who just threw out the airline mask mandate, 33-year-old Trump appointee and Federalist Society member Kathryn Kimball, never tried a case in court and was declared ‘Not Qualified’ to be a judge by a majority the [ABA]’s vetting committee,” Kurt Andersen commented. 

“The judge who made this ruling, Kathryn Kimball, is 35 yrs old,” journalist Sam Stein said. “Was confirmed at the age of 33 during the lame duck. Judiciary matters.”

“‘This woman is too young to be given such responsibilities’ is a take,” political commentator Noam Blum responded.

Christina Pushaw, a spokeswoman for Florida Gov. Ron DeSantis (R), mocked Stein, “Are you saying that lady brains aren’t fully developed before the age of 55?”

Fox News host Laura Ingraham made a general sarcastic comment about Mizelle’s ruling and the Left’s reaction. “I look forward to all the stories about how The Hon. Kate Mizelle who struck down the mask mandate is an example of a strong woman who thinks for herself,” she wrote.

Mizelle, a Florida native born in 1987, earned her law degree from the University of Florida in 2012, a profile from 10 Tampa Bay WTSP outlined. After college, she clerked for several federal judges, including Justice Thomas, before working in the private sector.

In 2020, then-President Donald Trump tapped Mizelle for a seat on the U.S. District Court for the Middle District of Florida. The liberal-leaning ABA sent a letter to a collection of senators claiming the judge was “not qualified” for the position.

Though others, including Florida Sen. Marco Rubio (R), sang Mizelle’s praises.

“Almost two years ago I enthusiastically pushed Judge Mizelle to be a district court judge,” Rubio posted to Twitter on Monday. “Today she issued a common sense decision that makes me especially proud that I did.”

The senator captioned a statement he posted about Mizelle back in August 2020. “I am pleased the President nominated Kat Mizelle to serve as a federal district court judge for the Middle District of Florida,” Rubio said. “Mizelle is a highly qualified nominee having served in various legal roles both in the public and private sector.”

She was nominated in September 2020 by President Donald Trump and was confirmed by the Senate later that year. Moody Jr. of the United States District Court for the Middle District of Florida. Judge Mizelle earned her B.A., summa cum laude, from Covenant College, and her J.D., summa cum laude, from the University of Florida Levin College of Law.
