Lawsuit to Keep Trump Off the 2024 Ballot Filed in Minnesota
A lawsuit has been filed in Minnesota to prevent former President Donald Trump from appearing on the 2024 ballot. The lawsuit argues that Trump’s involvement in the January 6, 2021 protest and Capitol incursion disqualifies him from holding office under Section 3 of the 14th Amendment.
The relevant section of the 14th Amendment states that no person who has engaged in insurrection or rebellion against the United States or provided aid to its enemies shall hold any office under the United States.
This legal effort follows a similar lawsuit in Colorado that also relied on the 14th Amendment as its basis. The lawsuit, filed by the liberal group Free Speech for People, accuses Trump of inciting a violent insurrection and attempting to overturn the results of the 2020 election.
The lawsuit argues that Trump’s actions, including his attempts to challenge the election, constitute a form of revolt. It claims that the events of January 6, 2021, amounted to an insurrection and a coordinated effort to obstruct the certification of President Biden’s victory.
According to Ron Fein, legal director at Free Speech for People, Trump’s actions pose a threat to the republic, and he should be barred from the ballot to protect the nation. Fein suggests that similar lawsuits may be filed in other states.
The Minnesota lawsuit targets Democratic Secretary of State Steve Simon, who has stated that he will not ban Trump from the ballot. Simon argues that his office does not have the legal authority to investigate a candidate’s eligibility for office.
In response to the lawsuits, Trump’s spokesman Steven Cheung dismissed them as baseless political attacks. Legal scholar Jonathan Turley also criticized the legal underpinnings of the lawsuits, arguing that they stretch the law beyond recognition.
While the outcome of the lawsuit remains uncertain, it highlights the ongoing debate over Trump’s role in the events of January 6, 2021, and the potential consequences for his political future.
