Judges Would Be Forced to Consider Defendant’s Race Under New Dem-Backed Bill
California lawmakers are considering a bill that would require judges to consider a person’s race when deciding how long to sentence them to prison, according to Fox News.
“It is the intent of the Legislature to rectify the racial bias that has historically permeated our criminal justice system as documented by the California Task Force to Study and Develop Reparation Proposals for African Americans,”
The proposed bill, known as Assembly Bill 852, aims to address racial bias in the criminal justice system. It would add a section to the California Penal Code, mandating that courts take into account how racial minorities have been disproportionately affected in order to “rectify racial bias.”
“Whenever the court has discretion to determine the appropriate sentence according to relevant statutes and the sentencing rules of the Judicial Council, the court presiding over a criminal matter shall consider the disparate impact on historically disenfranchised and system-impacted populations.”
The bill was introduced by Democratic Assembly Member Reggie Jones-Sawyer and was approved by the state Assembly in May. It is currently being debated in the state Senate.
The California Task Force to Study and Develop Reparation Proposals for African Americans, created by legislation signed by Democratic Governor Gavin Newsom in 2020, published its recommendations in June. The state legislature will now discuss whether to implement them.
According to NBC News, Jones-Sawyer is a member of the reparations task force.
Under the proposed bill, eligible black California residents could receive compensation for excessive policing, felony drug arrests, and disproportionate incarceration during the alleged war on drugs. The compensation could amount to more than $115,000, or roughly $2,352 per year of residency from 1971 to 2020, as reported by Fox News.
Jones-Sawyer did not immediately respond to the Daily Caller News Foundation’s request for comment.
