John Brennan sues Trump administration to preserve documents in DOJ investigations

Former CIA Director John Brennan has filed a lawsuit against the Trump administration to ensure the preservation of documents related to investigations into him. The Department of justice had previously confirmed an examination into Brennan concerning his handling of the inquiry into possible ties between President Donald Trump and Russia. BrennanS lawyers allege that he is currently under investigation for a supposed “grand conspiracy” and making false statements to congress. Brennan requests the court to order the government to preserve all relevant records, citing concerns over the government’s history of inadequate record-keeping. The DOJ has not initiated any criminal case against Brennan. In his lawsuit, Brennan also named officials such as acting Attorney General Todd Blanche, FBI Director kash Patel, and Trump, submitting it to the U.S. District Court for the District of Columbia.


Former CIA Director John Brennan filed a lawsuit against the Trump administration on Wednesday to ensure that administration officials preserve all documents related to any investigations into him.

The Department of Justice confirmed in July 2025 that the Trump administration was investigating Brennan in relation to his handling of the inquiry into possible ties between President Donald Trump and Russia, with sources alleging his conduct was being investigated as a “conspiracy.” In the lawsuit filed Wednesday, Brennan’s lawyers said he is currently under investigation by the Justice Department for an alleged “grand conspiracy” and for allegedly making false statements to Congress regarding the Russia inquiry.

In his lawsuit, Brennan asks the court to order the Trump administration to preserve all documents related to examinations of his conduct in any possible criminal case that could result from the investigations. Brennan’s lawyers argued that any criminal case would look into the documented history of the investigations and asked for the records to be preserved.

“Given the government’s questionable recent history with respect to its record preservation and other legal obligations, however, Director Brennan has a well-founded concern that those records and communications will not be preserved until such time as the court can review them for evidence of unconstitutional vindictiveness,” the complaint reads.

The DOJ has not yet opened any criminal case into Brennan’s actions.

Brennan named administration officials like acting Attorney General Todd Blanche, FBI Director Kash Patel, and Trump in the complaint. He filed in the U.S. District Court for the District of Columbia.
