Fan Sues WWE Alleging They Went Deaf Because Of Pyrotechnics

After claiming that their hearing was damaged during a Wrestlemania event, a WWE fan sued the organization.

Marvin Jackson said that he was an “invitee” Wrestlemania 38 at AT&T Stadium Arlington, Texas last season. He is accusing WWE Both negligence and liability are possible for failing to warn attendees about loud noises or pyrotechnic blasts. Jackson claims that the noises have caused him to lose nearly all of his hearing in his left ear.

“Plaintiff was seated next to the stage at the venue. When performance began, pyrotechnics went off. The blast from the pyrotechnics was so loud that it caused Plaintiff to lose almost all hearing in his left ear,” The lawsuit is here.

The article goes on to state that indoor pyrotechnics are considered an “anonymous”. “abnormally dangerous activity” for attendees. AT&T Stadium’s retractable roof was closed last year during the event.

“Due to the proximity of the pyrotechnics to the invitees, the indoor nature of the display, and the inherent danger of pyrotechnics, the degree of risk of harm to invitees was particularly high at WrestleMania 38. The likelihood of harm associated with those risks was commensurate with the risk,” The lawsuit was continued.

Anyone who has ever been to a wrestling event is aware that sometimes the explosions do come out of nowhere and if you’re not expecting them – they can definitely startle you.

Jackson believes that there should have been signs warning of loud pyro. His claims are not confirmed. He is seeking damages of more than $1,000,000

WWE filed a motion to change the venue to a different area of Texas. They have not yet commented on the lawsuit.
