Family Of Deceased 1-Year-Old Daughter Sues Airbnb, Others Over Deadly Fentanyl Toxicity Exposure

After their 19-month old daughter died from an overdose of fentanyl while on vacation in Florida, the family filed a lawsuit against Airbnb.

Boris and Lydie Levenir booked their family into Wellington’s four-bedroom, two bathroom lakehouse rental for three nights between August 6th to 8th, 2021. NBC reported. After watching TV and playing, Enora, the toddler, sat down on Enora’s bed with one of her siblings.

Enora and her family believed that their infant had died from Sudden Infant Death Syndrome. This syndrome is more common than SIDS. It affects approximately 3400 children under 1 year. It is not clear how Enora came to be ingesting the fatal opioid. This drug was responsible for more than 56,000 deaths in America from overdoses between 2000 and 2020 according the Centers for Disease Control and Prevention.

“There were no signs of any narcotic medications or any illegal narcotics at the crime scene and her death was listed as accidental,” The incident report was filed by the Palm Beach County Sheriff’s Office.

Report also stated that Enora’s baby formula, and her parents had been tested for drug use.

According to NBC, the complainant also accused the manager and owner of the rental space, along with the guest who booked it through VRBO vacation rentals.

According to a sheriff’s report, a neighbor of the property had reported that he was a thief. “large party” Two nights earlier, the Lavenirs checked into the lake house, the Lavenirs were there. This property was the residence of “parties and rentals prior to the family’s stay at the location.”

According to the lawsuit, Airbnb did not ensure that the property was secure before Lavenir arrived.

“In reality, the subject premises had a history of being used as a party house and had just days earlier hosted a group of approximately a dozen adults who used cocaine and other drugs, including but not limited to fentanyl throughout the home,” The suit states.

“It’s like we fell into a trap,” Boris Enora’s father told The Post.

The family’s Miami attorney Thomas Scolaro told The Post that partygoers may have brought fentanyl to the home.

“The only thing we have here is our common sense,” Scolaro said. “It was definitely in that unit, that Airbnb. Which particular person left the drugs is frankly not anything I’m trying to prove. What I want to show is Airbnb provided no cleanup, no warning, no measure of safety for the family.”

After losing Enora, the Lavenir family wants to raise awareness about the dangers associated with fentanyl.

“Fentanyl is incredibly potent. So you’re only talking about a couple of grains of salt-size particles, which would result in this level of toxicity to a 19-month-old baby,” Scolaro told NBC.

“I’m not surprised that the sheriff’s office did not find a vast reserve of fentanyl in the unit,” Scolaro added. “But what we do know based on the timeline, and based on the statements from these prior renters, is there were drugs in that unit and the child was not exposed anywhere else, period. There’s literally no other conceivable place this child could have encountered this fentanyl but in that rental home.”

Airbnb spokesmen told media outlets they offer condolences for the Lavenir families in a written statement.

“Our hearts go out to the Lavenir family and their loved ones for their devastating loss,” The spokesperson stated.

Airbnb has yet to file a court response.
