Supreme Court Faces Novel Second Amendment Challenge​ in Rahimi⁢ v. ⁤U.S.

As the Supreme Court prepares for ‌its next ⁢Second‌ Amendment case, ⁤legal ‌experts are divided ‍on ‍how ⁢the justices‌ will ‍rule on a ​groundbreaking challenge ‌to a longstanding federal law. This law prohibits⁤ domestic ‌abusers from ​possessing ⁢firearms.

The ​case,​ known​ as Rahimi v. ‍U.S.,​ involves Texas‌ resident ⁢Zackey ⁣Rahimi. Rahimi’s legal⁤ troubles​ began ⁣in 2019 when⁣ he fired⁢ a‌ gun at a passerby ⁤who witnessed him⁤ dragging ‍his girlfriend⁣ through a⁤ parking lot. Months later, ‌Rahimi ‌was ⁢involved in ⁢another shooting after a vehicular ⁤accident, ‌where ⁢he repeatedly shot at the other ‍driver. He also‍ threatened a⁣ woman ⁣with a gun​ and fired⁣ shots⁤ into the air‌ in separate ⁤incidents.

Rahimi’s public‌ defenders⁢ are‍ challenging one ⁤of his ⁣convictions under⁤ a 1994 federal statute that ⁢bars individuals subject to domestic ​violence ‌restraining ⁣orders from owning firearms.⁣ They argue that⁤ this ‍statute, ​known as ⁣922(g)(8), should ⁣not stand because it⁤ did ‌not exist at the ​time ‌of the​ nation’s founding.

Legal Battle ‍and Mixed Responses

The U.S. Court of Appeals ⁢for​ the 5th ⁣Circuit sided with Rahimi, calling the statute ‌an “outlier.” The Biden ‍administration appealed to​ the ⁣Supreme ​Court, which agreed to hear the⁤ case.⁤ Legal experts⁤ have​ provided mixed responses on ⁣how the case⁤ might resolve, ‍given ‍the court’s ⁣previous⁤ decision​ in​ Bruen‍ v. New‍ York‌ Rifle‍ & ​Pistol Assn.⁤ Some experts believe⁢ the court may uphold ‌the ‍statute, while ‌others think it ‍may⁤ affirm the 5th ‌Circuit’s decision.

Gun ⁢rights⁤ groups, including the ‌National ⁣Rifle⁢ Association, have been surprisingly quiet ‍about the case.‌ However, organizations⁤ focused on domestic violence and gun ​violence have⁢ suggested ‍that the‍ Supreme Court could⁤ rule ‍against⁣ Rahimi ⁢while ​upholding ​its recent Second Amendment ‍test from Bruen.

Despite ⁤the uncertainties, ⁢the⁣ outcome of ‌the Rahimi case ‍is ⁤expected to generate⁣ significant⁢ tensions ⁢and interest as ​major stakeholders⁢ weigh⁢ in‌ on the importance of upholding⁤ the 1994 statute.
