Equal Rights Amendment back on New York’s November ballot, marking a significant victory for Democrats

A New York court‌ has decided to reinstate the Equal Rights Amendment (ERA) to the state ⁢ballot for November, after ⁢it​ was previously removed ⁢by a different judge in ⁢May. This amendment, championed by Democrats,​ aims to prevent discrimination‍ and to specifically safeguard ‍abortion rights ‍under the state constitution. New York‍ Attorney General Letitia James hailed the court’s decision as ⁣a significant step towards protecting fundamental rights and freedoms, ‍emphasizing the continuing commitment to ensuring ‍safety and⁣ freedom for all New‌ Yorkers. The decision was⁢ celebrated ⁣as​ a crucial victory for both abortion access ⁢and the protection against discrimination⁣ for vulnerable communities in New York.

A New York court ruled in favor of placing the Equal Rights Amendment, an anti-discrimination ballot issue pushed by state Democrats, back on the November ballot after a judge struck it in May.

“Today’s decision to put the Equal Rights Amendment back on the ballot in November is a huge victory in our efforts to protect our basic rights and freedoms,” New York Attorney General Letitia James said in a statement. “The ERA was advanced to protect access to abortion care, enshrine this basic right in our constitution, and protect people from discrimination. We will continue to do everything in our power to protect these rights and ensure everyone can live safely and freely in the great State of New York.”

The turn of events is a boost for Democrats, who have hoped the ballot issue, which contains language protecting reproductive rights, will turn out voters in November. Republicans are opposed to the measure, which will add a ban on discrimination based on “ethnicity, national origin, age, disability, sex, sexual orientation, gender identity, gender expression, pregnancy, pregnancy outcomes and reproductive health care and autonomy” to the New York Constitution.

Some in the state’s GOP argue that it could be interpreted as forcing sports leagues to allow transgender athletes to compete on female teams or weaken parents’ ability to make decisions about transgender healthcare.


Several state Democrats celebrated the court’s decision. Democratic state Sen. Rachel May said, “The Equal Rights Amendment deserves to be decided on by New York voters. And it will be.”

Fellow Democratic state Sen. Lea Webb added to that, saying, “I am pleased that the Fourth Judicial Department Court has reversed the decision to remove the Equal Rights Amendment from the November ballot. New Yorkers should have the opportunity to protect the right to abortion in our state constitution and ensure equal protection from discrimination for all. … As Chair of the Women’s Issues Committee, I hope we can codify this amendment and enshrine reproductive freedom in our state’s constitution.”
