“Today’s decision to put the Equal Rights Amendment back on the ballot in November is a huge victory in our efforts to protect our basic rights and freedoms,” New York Attorney General Letitia James said in a statement. “The ERA was advanced to protect access to abortion care, enshrine this basic right in our constitution, and protect people from discrimination. The turn of events is a boost for Democrats, who have hoped the ballot issue, which contains language protecting reproductive rights, will turn out voters in November. Republicans are opposed to the measure, which will add a ban on discrimination based on “ethnicity, national origin, age, disability, sex, sexual orientation, gender identity, gender expression, pregnancy, pregnancy outcomes and reproductive health care and autonomy” to the New York Constitution.

Several state Democrats celebrated the court’s decision. Democratic state Sen. Rachel May said, “The Equal Rights Amendment deserves to be decided on by New York voters. And it will be.”
Fellow Democratic state Sen. Lea Webb added to that, saying, “I am pleased that the Fourth Judicial Department Court has reversed the decision to remove the Equal Rights Amendment from the November ballot. New Yorkers should have the opportunity to protect the right to abortion in our state constitution and ensure equal protection from discrimination for all. … As Chair of the Women’s Issues Committee, I hope we can codify this amendment and enshrine reproductive freedom in our state’s constitution.”
