Political legislation would make LGBT immigrants a” vulnerable girl” who” may not be detained.”

Democratsin the House and Senate introduced the Dignity for Detained Immigrants Act this week. The bill proposes the repeal of mandatory detention, the prohibition of family detention, the barring of the use of private detention facilities, and making it easier to release immigrants who qualify as a “vulnerable person.”

There are 11 requirements to be considered a” vulnerable person ,” including those who are under 21 year old, pregnant, identify as lesbian, gay, bisexual, trans, queer, or transgender, suffer from severe mental or physical disabilities, have limited English language skills, and have experienced gender-based crime.

The lawmakers wrote in the bill’s’s text that the alien may not be detained unless the Secretary of Homeland Security demonstrates, in addition to the requirements under paragraph ( 3 ), that it is unreasonable or not practicable to place him or her in a community-based supervision program. This is true for aliens who are subject to custody determinations under this subsection.

Reps. Pramila Jayapal( D-WA ), Sen. Cory Booker, and Adam Smith all introduced the bill this week.

According to Booker,” our immigration program has allowed for the cruel treatment of immigrants and stripped them of their society and due system.” The fundamental right of refugees detained in the US may be respected and safeguarded.

Smith referred to the current immigration system as” broken” and in desperate need of an” overhaul” that would restore” due process to our immigration process and center the humanity and dignity of people who come to this country to build a better life.”

Numerous Democrats from the House and the Senate, including Reps. Cori Bush( D-MO ), Gerry Connolly( R-VA ), Debbie Dingell, Sheila Jackson Lee, Hank Johnson, Alexandria Ocasio – Cortez, Ilhan Omar, Ayanna Pressley, and Rashida Tlaib, have now endorsed the bill.
