Delaware Literally Lowers The Bar To Increase Racial Diversity Of Lawyers, Judges

The Delaware Supreme Court is literally lowered This week, The First State changed the grade that is required to be certified as a lawyer to reflect its efforts to increase racial diversity in judges and lawyers. However, the people responsible insist that standards have not been lowered.

Certain barriers are in place to prevent unqualified individuals from securing very important jobs. However, Delaware Supreme Court Chief Judge Collins J. Seitz Jr. stated in a news release that, “the bar exam is not supposed to be a barrier to entering the profession but is supposed to be a test of an applicant’s ability to successfully practice law in Delaware, and I believe these reforms will help better reflect that purpose.”

Seitz was able to add that despite the lower standards. “this is not a lowering of the standards but a modernization of the process to better reflect how other states handle admission to the bar.”

Delaware has one of strictest bar exams in America, and Seitz insists that it will continue.

“The chief justice said these reforms will keep Delaware competitive in attracting top legal talent to the state and keep Delawareans interested in the law from going elsewhere,” According to the news release.

• Starting next year, the exam will be given twice annually — in February and July.
• The “cut” Or your passing score for the exam with 200 multiple choice questions will drop from 145 to143.
• The number and types of essays will be reduced from eight to four. Additionally, the number of law areas that are eligible for essays will be reduced from 14 down to 10.
• Reduced clerkship requirement from 21 to 12 weeks
• Reduce the number of legal proceedings that potential lawyers must attend, from a 25-item mandatory list to just 18 of the 30 possible items.
• Reduction in late application fees for law school graduates and lawyers admitted in another state

National Review reported that Chuck Durante, President of Delaware State Bar Association, welcomed the changes and was not surprised by them. “traditional barriers” as not being welcoming to minorities.

Durante stated that the changes were made to “remove certain impediments to Delaware bar applications, to rip some bars wire from the welcome mat and some traditional barriers which had become something quite artificial,” Durante explained.

Then, Durante (who is white) went on a racial tangent about “white people” and how the Delaware criteria used to dissuade Hispanic and black applicants.

The attorney claimed that “attitudes must continue to evolve in Delaware. White people generally who have their antennae up, who understand what is happening in society, have learned the meaning of microaggression.”

“They’ve learned the meaning of how to be welcoming, how to be professional, how to make this community better suited for diversity in its professional class, including its lawyers,” He added.

This sounds almost like Durante believes that “white people” At large, we need to keep adapting to woke ideology, and bow to the altar of diversity and equity.

Although the standards may still be high, they are changing. This means that less qualified lawyers will be allowed to practice law in Delaware. New attorneys will be less experienced due to changes such as decreased clerkships or minimal legal proceedings.

If financial barriers are preventing qualified minorities from applying for the state bar, then why not focus on making them more affordable through upfront reductions, scholarships, and grants? That would open the bar exam to all lower-income individuals — not just those of certain races, as Durante made clear was the goal.

Two ways to immediately increase racial diversity are possible based on immutable demographics. The first is blatant discrimination which is illegal, but it is often attempted by the Left. One is to lower standards in order to make it easier for more people. “winners” — so to speak.

Of course, in both cases, the final product — or in this case the quality of attorneys — is weakened because immutable characteristics rather than merit are prioritized. The clients who depend on their attorneys to win in court will ultimately suffer, as the Delaware Bar exam compromises quality for DEI.
