Penny put the man, Jordan Neely, in a chokehold after Neely began screaming that he didn’t care if he went to jail. In an interview with Fox News, Penny’s attorney, Steve Raiser, explained that his client was “fearful for the safety of those passengers” and acted to keep them safe from attack.

Raiser explained that a grand jury was impaneled to determine if charges should be brought against Penny, but they were surprised when they received a call asking him to surrender to the police department the next day.

Despite accusations of racism, Raiser dismissed the claims, stating that Penny’s actions had nothing to do with race. “Danny put his life at risk to save all those people. It has nothing to do with race.”
