DACA Policy Ruled Illegal, but Remains in Place

A Federal Appeals Court has ruled against an Obama-era immigration policy that protects “DREAMers.”

On Wednesday, a three-judge panel in New Orleans, Louisiana ruled that the Deferred Action for Childhood Arrivals (DACA) program violated federal law. The court affirmed a 2021 ruling by a Texas district court.

The DACA program provides administrative reliefs and deportation protection to immigrants who entered the United States unlawfully as children. Those in the program can apply for a driver’s license, social security number and work permits, as opposed to a legal path of citizenship.

The Texas ruling stated the program was a case of presidential authority overreach due to Congress not giving the executive branch the power to grant mass reprieves to “DREAMers.”

To note, the court did not cancel the program for current recipients. The program is allowed to remain as is but it cannot receive new applications while it is under review.
