Congress Spotlights American Bar Association’s DEI Obsession

Democrats on the committee dismissed the concerns as time-wasting. The hearing also featured witnesses criticizing the ABA’s ideological bias and it’s impact on the legal system. the event underscored ongoing debates over the ABA’s influence and partisan leanings within the legal community.

That is the laughable claim ABA President Michelle Behnke tried to sell during a Wednesday hearing before the House Oversight Committee’s Task Force on Defending Constitutional Rights and Exposing Institutional Abuses. And judging by their remarks, it’s one the body’s Republican members clearly weren’t buying.
For context, the American Bar Association is an organization that wields immense power and influence throughout the country’s legal system. Not only does it play a big role in law school accreditation and judicial nominations, but it also establishes standards for legal conduct throughout the profession and files briefs in high-profile court cases.
Despite regularly professing to be “nonpartisan,” however, the ABA has repeatedly shown itself to be a left-wing advocacy organization. As noted by the Capital Research Center, the group “has supported and lobbied for a broad left-of-center agenda on issues including criminal justice policy, immigration, abortion, LGBT issues, and gun control.” It’s also embraced DEI ideology and “has adopted lobbying priorities including legal status for nearly all illegal immigrants living in the United States, the repeal of mandatory-minimum sentencing laws, taxpayer-funded abortions for low-income Americans, and the implementation of affirmative action programs.”
Many of these left-wing positions took center stage during Wednesday’s House hearing.
Throughout his opening statement, Task Force Chairman Brandon Gill, R-Texas, underscored how the ABA “has continuously pursued discriminatory DEI practices.” These policies, he said, “seek to pit Americans against one another on account of their immutable characteristics, and, at their core, fundamentally reject the American ideal of equal justice and of achieving success based on one’s merit.”
The Texas congressman went on to repeatedly press Behnke — who reaffirmed her support for DEI in the legal profession — on the ABA’s leftist views on “diversity” and “inclusion.” This included asking the ABA president about the organization’s apparent obsession with “implicit bias.” As The Federalist previously observed, “Implicit bias training is a common component of critical race theory and has been proven to be scientifically inaccurate to the point that some of the researchers who developed implicit bias tests have now repudiated them as wildly inaccurate and unreliable.”

The ABA’s left-wing policy preferences also appeared to be top of mind for House Judiciary Chair Jim Jordan, R-Ohio, and Rep. Michael Cloud, R-Texas.
In challenging Behnke’s assertion that the ABA is “nonpartisan,” Jordan observed how the group has espoused support for abortion. He also noted how the ABA has voiced opposition to the detention of “individuals in immigration proceedings except in extraordinary circumstances” and policies that keep trans-identifying men out of women’s sports.
Meanwhile, Cloud highlighted recent reporting indicating that more than 80 percent of the amicus briefs filed by the ABA in Supreme Court cases over the past decade “favored a liberal or progressive outcome.” He further contrasted the ABA’s apparent lack of concern with the left’s efforts to disbar President Trump’s former lawyers and the absence of similar treatment for left-wing lawyers who advanced “new and novel legal parameters to creation a prosecution case against him.”
Unsurprisingly, the task force’s Democrat members ran interference for racist DEI policies in the American legal system and characterized the hearing as a “wast[e]” of time.
Other witnesses at Wednesday’s hearing included Zach Smith, a senior legal fellow at the Heritage Foundation’s Legal Policy Center, and David Blackman, a former law student and former member of the Texas State Guard.
