NASCAR’s Discriminatory Diversity Internship Program Sparks Controversy
NASCAR, the renowned race car giant, has come under fire for its “diversity internship program” that explicitly excludes white individuals from applying based on their race. This stipulation has raised concerns among legal experts who argue that it is “blatantly illegal.”
The program’s requirements state that applicants must belong to specific racial or ethnic minority classifications, including Black or African American, American Indian or Alaska Native, Asian, Latino or Hispanic, and Native Hawaiian or Other Pacific Islander.

Constitutional lawyer David Bernstein from George Mason University’s Antonin Scalia School of Law asserts that NASCAR’s racially discriminatory program violates Title VII and the 1866 Civil Rights Act. He emphasizes that even under the most lenient interpretation, a 100% quota for minorities is illegal. Any individual who is unable to apply due to their race would have legal grounds to sue the company.
NASCAR’s diversity internship program is part of a larger initiative called “Drive for Diversity,” which includes race-based mentorship programs. The “Pit Crew Development Program” offers comprehensive training for aspiring minority and female pit crew members, while the “Driver Development Program” provides coaching, mentorship, and development opportunities for top minority and female drivers.

Both programs explicitly state that only females or individuals belonging to specific ethnic minority classifications, such as American Indian, Asian or Pacific Islander, African American, and Latino or Hispanic, are eligible.
Ironically, despite implementing racial requirements for program applicants, NASCAR’s job postings claim to be an equal opportunity employer. The company states that it seeks to attract and retain the best qualified individuals, and that all qualified applicants will be considered without regard to race.
NASCAR has faced criticism in recent years for its perceived shift towards a more politically correct stance. Last year, it issued an apology for featuring Texas’s Republican Governor Greg Abbott at one of its races. Additionally, the indefinite suspension of a driver for “liking” a meme related to George Floyd’s death has sparked calls for a boycott among some fans.
It is worth noting that NASCAR is not the only company to impose race-based requirements for career opportunities. Tech industry giant Oracle, as well as companies like Best Buy, Liberty Mutual, US Bank, and Bayer Pharmaceuticals, have participated in programs that exclude white employees based on their race.
Recently, attorneys general from 13 different states issued a warning to companies, stating that they will face serious legal consequences if they engage in racial discrimination.
NASCAR has not responded to requests for comment regarding its diversity internship program.
