Attorney General Merrick Garland Denies Allegations of Special Counsel Powers Requested for Hunter Biden Investigation

Attorney General Merrick Garland has firmly denied recent whistleblower claims that U.S. Attorney David Weiss sought special counsel powers to investigate Hunter Biden. These allegations emerged following years of accusations of stonewalling within the Justice Department.

Furthermore, Garland refuted the assertion that Weiss was twice prevented from bringing criminal charges against President Joe Biden’s son in jurisdictions outside of Delaware.

Whistleblower Accounts Shed Light on Hunter Biden Investigation

The whistleblower claims were made by two IRS Criminal Investigation agents who played significant roles in the Hunter Biden investigation. Gary Shapley, a supervisory special agent with the IRS’s criminal investigation, and an unnamed IRS case agent, referred to as “Whistleblower X,” provided crucial information.

According to the whistleblowers, Weiss had indeed sought special counsel powers but was denied. Additionally, they revealed that the Delaware federal prosecutor had attempted to bring criminal charges against Hunter Biden in California and Washington, D.C., where the younger Biden’s tax crimes had taken place. However, federal prosecutors appointed by President Biden in those districts rejected these efforts.

Garland Denies Allegations and Affirms Weiss’s Authority

During a press conference announcing charges related to Chinese fentanyl precursor chemical manufacturers, Garland categorically denied all the allegations. He emphasized that Weiss, appointed by President Trump as the U.S. Attorney in Delaware, had complete authority to make decisions and prosecute the case in any district.

Garland also clarified that Weiss never requested special counsel designation from him, as the attorney general is the only person with the authority to grant or refuse such a request. The attorney general defended his decision not to appoint Weiss as a special counsel, stating that the Delaware federal prosecutor already possessed more authority than a special counsel would have had.

Whistleblower Testimonies Reveal Frustration and Contention

The whistleblowers recounted a pivotal meeting on October 7, 2022, at the federal prosecutor’s office in Delaware, where Weiss was present along with senior-level managers from IRS CI, FBI, and the Delaware U.S. Attorney’s Office. During this meeting, Weiss surprised the group by stating that he was not the deciding official on whether charges would be filed.

According to the whistleblowers, Weiss revealed that U.S. Attorney Matthew Graves of the District of Columbia had refused to allow charges to be filed in his district. They also claimed that Weiss had requested special counsel authority but was denied, being instructed instead to follow a process involving another U.S. Attorney appointed by President Biden.

The whistleblowers expressed concern over the handling of the case, particularly regarding the expiration of the statute of limitations for certain tax violations. They felt misled by Weiss’s office and frustrated by the lack of progress in charging Hunter Biden for alleged crimes.

Garland Supports Weiss’s Testimony

Garland expressed his support for Weiss, stating that he would be willing to testify and explain the matters surrounding the investigation when he deems it appropriate.
