Lawyer: Daniel Penny did not intend to kill anyone.

Attorney for Daniel Penny Pushes Back on Claims

Thomas Kenniff, an attorney for Daniel Penny, pushed back on claims this week from the family attorney of Jordan Neely, who claimed that Penny thought he had the right to take someone’s life.

In an interview with Martha MacCallum on “The Story,” Kenniff responded to a statement from the Neely family, who accused Penny of not letting go of a chokehold until Jordan was dead. Kenniff vehemently denied the claim, stating that it was absurd to suggest that Penny intended to take anyone’s life.

Reasonable Steps Taken to Subdue Threatening Environment

“This was a situation where my client, who is just an everyday New Yorker, was put in a situation that none of us would want to be in and took reasonable steps to try to subdue someone who had introduced a frightening, threatening environment into that subway train,” Kenniff said.

According to Kenniff, Penny was simply trying to protect himself and others on the train from a threatening situation. Witnesses who will testify in the grand jury proceeding will attest to the frightening and terrifying situation that occurred on the train.

No Political Motivations

Despite attempts to politicize the case, Kenniff emphasized that there is nothing political about it. This is simply a case of an everyday young man who was confronted with a difficult and frightening situation and took appropriate steps to try to restrain someone who was a threat.

Fair Trial Expected

While some have expressed concerns about whether Penny can receive a fair trial in New York, Kenniff has no doubts. He has been trying cases in New York City for 20 years and believes that Manhattan jurors will be able to relate to the situation that confronted Penny and the other passengers on the train.

As the trial progresses, Kenniff will continue to represent Penny and fight for justice.
