California Lt. Gov. Fails as Constitutional Expert, Misinterprets Age Requirement for Presidency


The Democrat lieutenant governor of California is urging the⁢ state’s top election official to exhaust all legal avenues in order to remove former President Donald Trump from the ballot in the upcoming ⁤election. However, her arguments based on the Constitution are flawed.

“The constitution [sic] is clear,” wrote Lt. Gov. Eleni Kounalakis on Wednesday. “[Y]ou ‌must be 40 years old and not be an insurrectionist.”

However, the Constitution actually states that the minimum age requirement for the presidency is 35.

Kounalakis’ ‌letter comes in response ⁣to a controversial decision by the Colorado⁣ Supreme Court to bar Trump ‍from the 2024 ballot due to‌ his involvement in⁢ the Capitol riot. The​ court, ​comprised entirely of Democratic-appointed justices, cited a provision from the 14th Amendment ⁣to disqualify​ the​ former⁣ president.

Trump’s legal team ‍plans to appeal the decision to the U.S. Supreme Court.

Following the ruling, George Washington University law professor Jonathan Turley criticized the decision as “the most anti-democratic opinion”‌ he‌ has ever seen.
