That provision, Chirafisi, was necessary to prevent prosecutors from deliberately ruining their own case to get \u201canother kick at the cat.\u201d He said that prosecutors, led by Assistant District Attorney Thomas Binger, had acted in \u201cbad faith\u201d \u2014 a key element of dismissal with prejudice.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>The motion came after a lunch break, and after Judge Schroeder had <a href=\"https:\/\/www.breitbart.com\/law-and-order\/2021\/11\/10\/furious-judge-in-rittenhouse-trial-accuses-prosecution-of-grave-constitutional-violation\/\">admonished<\/a> the prosecution that it had committed a \u201cgrave constitutional violation\u201d by referring to Rittenhouse\u2019s previous silence, which conflicts with his Fifth Amendment right to remain silent.<\/p>\n<p>Earlier, the following exchange took place:<\/p>\n<blockquote readability=\"21\">\n<p><strong>Defense attorney:<\/strong> Your Honor \u2014 I don\u2019t want the jury to hear \u2014 he\u2019s commenting on my client\u2019s right to remain silent.<\/p>\n<p><strong>Prosecutor:<\/strong> No, Your Honor. I am making the point that after hearing everything int he case, now he\u2019s tailoring his story to what has already been introduced.<\/p>\n<p><strong>Judge:<\/strong> The problem is, this is a grave constitutional violation for you to talk about the defendant\u2019s silence, and that is \u2014 and you\u2019re right on the borderline, and you may be over it. But it better stop.<\/p>\n<p><strong>Prosecutor:<\/strong> Understood.<\/p>\n<p><strong>Judge:<\/strong> This is \u2014 I can\u2019t think of the case, the initial case on it. But this is not permitted.<\/p>\n<\/blockquote>\n<p>There was another interruption later, when the judge admonished the prosecution for discussing excluded evidence.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>In his defense, Binger said that Rittenhouse, who took the stand in his own defense, commented on some of the excluded material.<\/p>\n<p>Judge Schroeder berated Binger again, saying that he had been trying to find a way around his previous rulings. \u201cWhen you say that you had been acting on good faith, I don\u2019t believe that,\u201d he said.<\/p>\n<p>The judge reserved judgment on the motion.<\/p>\n<p>Later, when the prosecution argued for the admission of a photograph into evidence showing Rittenhouse wearing a shirt with an expletive on it, the just noted that&nbsp;Rittenhouse is not on trial for \u201cexquisitely bad judgment\u201d or \u201cbehaving in a very offensive way,\u201d but for murder.<\/p>\n<p><em>Joel B.
