Slatery III announced that his state, along with six others (Kentucky, Idaho, Kansas, Ohio, Oklahoma, and West Virginia), are challenging the Biden administration\u2019s vaccine mandate at the U.S. Court of Appeals for the Sixth Circuit.<\/p>\n<p>Slatery said in a <a href=\"https:\/\/www.tn.gov\/attorneygeneral\/news\/2021\/11\/5\/pr21-43.html\">press release<\/a>:<\/p>\n<p><em>As we anticipated, the mandate asserts an unprecedented expansion of emergency regulatory powers by a federal agency \u2026 Its scope and breadth is only exceeded by its length (about 500 pages). It also fails to consider the many steps already taken to prevent the spread of COVID-19 by individuals, employers and our state.<\/em><\/p>\n<p>According to the release, the attorneys general argue that \u201cOSHA lacks statutory and constitutional authority to issue\u201d such a mandate, and that the mandate takes authority away from sovereign states that are \u201cenacting and enforcing\u201d their own COVID-19 policies and protocols.<\/p>\n<p>The <a href=\"https:\/\/www.tn.gov\/content\/dam\/tn\/attorneygeneral\/documents\/pr\/2021\/pr21-43-petition.pdf\">lawsuit<\/a> reads in part:<\/p>\n<p><em>Pursuant to Fed. R. App. 15, section 6(f) of the Occupational Safety and Health Act, 29 U.S.C. \u00a7 655(f), and the Administrative Procedure Act,<\/em><\/p>\n<p><em>5 U.S.C. \u00a7\u00a7 551\u2013706, the Commonwealth of Kentucky and the States of Idaho, Kansas, Ohio, Oklahoma, Tennessee, and West Virginia (the \u201cPetitioner States\u201d) hereby petition the Court for review of the emergency temporary standard entitled \u201cCOVID-19 Vaccination and Testing; Emergency Temporary Standard\u201d issued by the U.S. Department of Labor\u2019s Occupational Safety and Health Administration\u2026<\/em><\/p>\n<p><em>On this date, Petitioner States are also filing a motion to stay the emergency temporary standard pending the Court\u2019s review pursuant to Fed. R. Following the announcement, The Daily Wire <a href=\"https:\/\/www.dailywire.com\/news\/jeremy-boreing-explains-daily-wires-lawsuit-over-joe-bidens-vax-order-grotesque-abuse-of-power\">filed a lawsuit<\/a> against the administration.<\/p>\n<p>\u201cWe\u2019re not the enforcement arm of the federal government. Forcing Americans to choose between their livelihoods and their freedom is a grotesque abuse of power and we won\u2019t be a party to it,\u201d said Jeremy Boreing, co-founder and co-CEO of The Daily Wire. \u201cWe will not incur the cost of implementing this testing regime. We will not incur the liability of inserting ourselves into the private health decisions and information of our employees.
