Bruen<\/em>gun, the focus of which is a New York statute requiring applicants for a handgun carry permit to prove they have a genuine need, or \u201cproper cause,\u201d to carry a gun outside the home. Similar laws exist in California and New Jersey.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>The <em>New York Times<\/em> <a href=\"https:\/\/www.nytimes.com\/2021\/11\/03\/us\/politics\/supreme-court-guns-second-amendment.html\">reports<\/a> that at one point, Chief Justice John Roberts responded to attorneys by noting that the rights protected by the Second Amendment are constitutional ,just as rights protected by the First Amendment are constitutional.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>Roberts observed:<\/p>\n<blockquote readability=\"13\">\n<p>You don\u2019t have to say, when you\u2019re looking for a permit to speak on a street corner or whatever, that, you know, your speech is particularly important. So why do you have to show in this case, convince somebody, that you\u2019re entitled to exercise your Second Amendment right?<\/p>\n<\/blockquote>\n<p>Justice Kavanaugh focused on how the \u201cproper cause\u201d requirement puts carry applicants in a position where their ability to carry a gun depends on their success in persuading an officer to allow it.<\/p>\n<p><em>USA Today<\/em> <a href=\"https:\/\/www.msn.com\/en-us\/news\/us\/supreme-court-majority-skeptical-of-new-york-law-that-limits-carrying-handguns-in-public\/ar-AAQhrNV?ocid=msedgntp\">quoted<\/a> Kavanaugh saying, \u201cThat\u2019s the real concern, isn\u2019t it, with any constitutional right. If it\u2019s (at) the discretion of an individual officer, that seems inconsistent with an objective constitutional right.\u201d<\/p>\n<p>Kavanaugh also asked, \u201cWhy isn\u2019t it good enough to say, \u2018I live in a violent area, and I want to defend myself?\u2019\u201d<\/p>\n<p>The case is&nbsp;<em>NYSRPA v.
