New York officials argue that if the Supreme Court strikes down this statute,&nbsp;it could have a domino effect, jeopardizing the other states that have this law, as well as endanger&nbsp;others that restrict public carry in places like airports or schools.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>Meanwhile, 41 states are considered \u201cshall issue\u201d jurisdictions, <a href=\"https:\/\/www.cbsnews.com\/live-updates\/supreme-court-gun-permit-concealed-carry-law-new-york-rifle-association-v-bruen\/\">notes<\/a> CBS News. A \u201cshall issue\u201d jurisdiction means that applicants seeking a concealed carry license must meet a basic set of requirements under state law to receive one but do not need to&nbsp;demonstrate a need to carry. Some&nbsp;states also now require no permit at all.<\/p>\n<p>Former U.S. Solicitor General Paul Clement \u2014 who spoke on behalf of the petitioners during the Supreme Court\u2019s hearing on&nbsp;<em>New York State Rifle &amp; Pistol Assn. v. (Dana Verkouteren via AP)<\/p>\n<\/div>\n<p>Clement <a href=\"https:\/\/www.supremecourt.gov\/oral_arguments\/argument_transcripts\/2021\/20-843_8n5a.pdf\">argued<\/a> that the mere concept of needing \u201cto show that you have an atypical need to exercise the right that distinguishes you from the general community\u201d does not describe a right, but rather, \u201cdescribes a privilege.\u201d<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>\u201cIt does not describe a constitutional right. That is a sufficient basis to invalidate the law,\u201d&nbsp;Clement said.<\/p>\n<p>Chief Justice John Roberts \u2014 who some may believe to be a swing vote in this case \u2014 appeared&nbsp;likely to strike down New York\u2019s law, noting that \u201cregardless of&nbsp;what the right is, it would be surprising to have it depend upon a permit system.\u201d<\/p>\n<p>\u201cYou can say that the right is limited in a particular way, just as First Amendment rights are limited, but the idea that you need a license to exercise the right, I think, is unusual in the context of the Bill of Rights,\u201d Roberts said.<\/p>\n<p>Roberts also suggested that there is a difference between&nbsp;licensing in order to check if an individual has a criminal record and&nbsp;licensing in order to simply&nbsp;exercise one\u2019s right&nbsp;under the Second Amendment.<\/p>\n<div id=\"attachment_16622102\" class=\"wp-caption aligncenter\" readability=\"46\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/10\/Supreme-Court-Justices-2021.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-16622102\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/10\/Supreme-Court-Justices-2021.jpg\" alt=\"WASHINGTON, DC - APRIL 23: Members of the Supreme Court pose for a group photo at the Supreme Court in Washington, DC on April 23, 2021. (Erin Schaff-Pool\/Getty Images)<\/p>\n<\/div>\n<p>Justice Brett Kavanaugh asked&nbsp;New York Solicitor General&nbsp;Barbara Underwood \u2014&nbsp;who spoke on behalf of the respondents \u2014 what she believes the problem is with shall-issue jurisdictions that exist in other states.<\/p>\n<figure id=\"M-ROS-B3\" class=\"a8d adSo\"><\/figure>\n<p>Underwood claimed that \u201cshall-issue regimes\u201d mean more people will be carrying firearms, which can \u201cgreatly proliferate the likelihood that mistakes will be made, fights will break out.\u201d<\/p>\n<p>\u201cBut has that happened in those states?\u201d asked Kavanaugh of shall-issue jurisdictions in other states. \u201cCan you make a comparative judgment?\u201d<\/p>\n<figure id=\"D-ROS-B2\" class=\"a8d\"><\/figure>\n<p>Kavanaugh added:<\/p>\n<blockquote readability=\"14\">\n<p>Because it seems like before you impose more restrictions on individual citizens and infringe their constitutional rights based on this theory, you should have to show, well, in those other states&nbsp;that have shall issue-regimes, actually, there is a lot more accidents, crime. And I don\u2019t see any real evidence of that.<\/p>\n<\/blockquote>\n<p>When Brian Fletcher \u2014&nbsp;who spoke on behalf of the Biden administration supporting New York\u2019s restrictions \u2014&nbsp;suggested the New York law is a \u201clegitimate regulation\u201d because \u201csimilar laws&nbsp;have been enacted\u201d not just in New York and other states, but \u201cthroughout large swaths of our nation\u2019s history,\u201d Justice Samuel Alito&nbsp;pushed back.<\/p>\n<div id=\"attachment_18603626\" class=\"wp-caption aligncenter\" readability=\"38\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/11\/Underwood.jpeg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-18603626\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/11\/Underwood.jpeg\" alt=\"Acting New York state Attorney General Barbara D. (AP Photo\/Hans Pennink)<\/p>\n<\/div>\n<p>\u201cWould we be receptive to arguments like that if we were interpreting, let\u2019s say, the First Amendment or the Confrontation Clause of the Sixth Amendment?\u201d Alito inquired.<\/p>\n<figure id=\"M-ROS-B4\" class=\"a8d adSo\"><\/figure>\n<p>Alito added that one \u201ccan find a lot&nbsp;of state laws and state court decisions\u201d from the late 19th Century and early 20th Century \u201cthat are inconsistent with a claim that is made based on the original meaning of \u2014 a provision of the Bill of Rights.\u201d<\/p>\n<p>Justice Clarence Thomas pointed out that Underwood appears to rely on \u201cthe density of the population\u201d when making her argument about keeping the New York law, and is thus suggesting that \u201cthe more rural an area is, the more unnecessary a strict rule is.\u201d<\/p>\n<p>Thomas, therefore, wondered what the cutoff would be between rural and high-density locations, asking, \u201chow rural does the area have to be before [New York\u2019s] restrictions shouldn\u2019t apply?\u201d<\/p>\n<p>Justice Amy&nbsp;Coney Barrett, however, appeared&nbsp;open to New York officials\u2019 arguments defending its regulations and mentioned New York City during New Year\u2019s Eve being a \u201csensitive place\u201d where \u201cpeople are on top of each other.\u201d<\/p>\n<p>Barrett said:<\/p>\n<blockquote readability=\"11\">\n<p>I think the way the New York statute works is consistent with a reasonable rule, which is that there\u2019s not a cutoff, there\u2019s not a number at which things change, but that licenses \u2014 unrestricted licenses are much more readily available in more \u2014 in less densely populated upstate counties than they are in dense metropolitan areas.<\/p>\n<\/blockquote>\n<p>\u201cI guess it\u2019s about the level of generality,\u201d Barrett continued. \u201cIf you concede, as I think the historical record requires you to, that states did outlaw guns in sensitive places.\u201d<\/p>\n<div id=\"attachment_18603786\" class=\"wp-caption aligncenter\" readability=\"36\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/11\/Times-Square.jpeg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-18603786\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/11\/Times-Square.jpeg\" alt=\"In this January 1, 2020 photo, confetti falls at midnight on the Times Square New Year&#039;s Eve celebration in New York. Because now we\u2019ve seen, you know, people are on top of each other, we\u2019ve had experience with violence, so we\u2019re making a judgment, it\u2019s a sensitive place,\u201d&nbsp;Barrett added.<\/p>\n<p>Even if Justice Barrett does side with New York officials, Justices Clarence Thomas, Samuel Alito, Neil Gorsuch, Brett Kavanaugh \u2014 and possibly even Chief Justice John Roberts \u2014 may not.<\/p>\n<p>The case is&nbsp;<em>New York State Rifle &amp; Pistol Association v.
