Version: 4.0.47--><p class=\"subheading\">The U.S. Environmental Protection Agency (EPA) said on Tuesday it will move forward with drafting sweeping rules targeting greenhouse gas emissions from power plants, despite the U.S. Supreme Court\u2019s decision to take up a lawsuit challenging the federal government\u2019s authority to heavily regulate the nation\u2019s energy sector.<\/p>\n<p>The lawsuit <a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/west-virginia-v-environmental-protection-agency\/\">focuses on<\/a>&nbsp;<a href=\"https:\/\/casetext.com\/statute\/united-states-code\/title-42-the-public-health-and-welfare\/chapter-85-air-pollution-prevention-and-control\/subchapter-i-programs-and-activities\/part-a-air-quality-and-emission-limitations\/section-7411-standards-of-performance-for-new-stationary-sources\">42 U.S.C. \u00a7 7411(d)<\/a>, a provision allowing the EPA to issue rules \u2014 including some that could remake the nation\u2019s electricity grids and unilaterally decarbonize virtually any sector of the economy \u2014 \u201cwithout any limits on what the agency can require so long as it considers cost, non-air impacts,\u201d and the nation\u2019s energy requirements.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>\u201cEPA will continue to move forward and use its statutory authority to be sure that we protect the public from harmful pollution, greenhouse gas pollution and pollution that contributes to the degradation of air quality,\u201d Michael Regan said in an interview with Reuters.<\/p>\n<p>\u201cIrrespective Congress does, EPA will move forward with its statutory authority,\u201d Regan said.<\/p>\n<p>Reuters <a href=\"https:\/\/www.reuters.com\/business\/environment\/us-epa-draft-power-plant-emissions-rules-despite-court-ruling-2021-11-02\/\">reported<\/a>:<span class=\"Apple-converted-space\">&nbsp;<\/span><\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<blockquote readability=\"18.590769230769\">\n<p>The EPA is working on a proposal to regulate carbon dioxide emissions from coal-fired power plants, a major source of greenhouse gases, after a Trump-era rule was struck down by a federal appeals court in 2019 as \u201carbitrary and capricious\u201d.<\/p>\n<p>The Supreme Court on Friday <a href=\"https:\/\/www.reuters.com\/world\/us\/us-supreme-court-hear-bid-curb-federal-power-limit-carbon-emissions-2021-10-29\">agreed to hear<\/a> a bid by states, including coal producer West Virginia, and industry groups to limit federal power to use the landmark Clean Air Act to regulate carbon emissions from power plants.<\/p>\n<p>Regan said he expects the court to back the EPA\u2019s authority, and added that he also remains confident Biden can work with a divided Congress to pass important climate legislation.<\/p>\n<\/blockquote>\n<p>West Virginia Attorney General Patrick Morrisey celebrated the High Court\u2019s decision to take up the case.<\/p>\n<div id=\"attachment_15007462\" class=\"wp-caption aligncenter\" readability=\"37\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/11\/AG-Patrick-Morrisey.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-15007462\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/11\/AG-Patrick-Morrisey.jpg\" alt width=\"640\" height=\"480\" \/><\/a><\/p>\n<p class=\"wp-caption-text\">Patrick Morrisey speaks to reporters after a debate in Morgantown, West Virginia, on November 1, 2018. (AP Photo\/Raymond Thompson, File)<\/p>\n<\/div>\n<p>The <em>Dominion Post<\/em> <a href=\"https:\/\/news.yahoo.com\/morrisey-celebrates-u-supreme-court-111500953.html\">reported<\/a> on reactions from the state that would be heavily affected by new regulations:<\/p>\n<blockquote readability=\"19\">\n<p>The case stems from a 27-state case led by Morrisey against the Obama-era Clean Power Plan, which resulted in a stay of the plan by the Supreme Court in 2016. In 2019, the Trump EPA replaced it with the Affordable Clean Energy Rule, which established emissions guidelines for states to use when developing plans to limit carbon dioxide at their coal-fired power plants. States would have three years to submit plans, in line with other planning timelines under the Clean Air Act.<\/p>\n<p>But in January of this year, the U.S. Court of Appeals for the District of Columbia Circuit vacated the 2019 Affordable Clean Energy Rule. In the current petition, Morrisey and the other states say the D.C. Court wrongly used a portion of the Clean Air Act to grant the EPA even more sweeping powers.<\/p>\n<\/blockquote>\n<p>\u201cThe stakes are certainly are very high,\u201d Morrisey said. \u201cCongress never gave EPA a blank check to address climate change.\u201d<\/p>\n<p>He said states should have a seat at the table when Congress considers fundamental and transformative policies.<\/p>\n<p>The case is <em>West Virginia v.
