In the case brought by Whole Women\u2019s Health, the Court will be asked to weigh in on the law\u2019s private enforcement mechanism, and in the second case, <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.txwd.1146510\/gov.uscourts.txwd.1146510.68.0_3.pdf\"><em>United States v. Texas<\/em><\/a>, the Court will ultimately decide whether President Joe Biden\u2019s Department of Justice has the right to sue Texas in order to block the law.<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>The legislation was signed by Texas Gov. Greg Abbott (R) in May and went into effect on September 1.&nbsp; Since women do not often detect pregnancy prior to the sixth week, the law effectively bans abortions in the state.<\/p>\n<p>The law is different from other pro-life legislation tried in the past, in that the general public \u2014 instead of the government \u2014 can enforce it. Any private citizen may file a civil lawsuit against an abortion provider or any other individual who \u201caids or abets\u201d a \u201ccriminal abortion.\u201d Abortionists and those who \u201caid or abet\u201d an abortion after a fetal heartbeat is detected must pay damages of at least $10,000 for each abortion performed or assisted.<\/p>\n<p>On October 15, a three-judge panel of the U.S. Court of Appeals for the Fifth Circuit voted 2-1&nbsp;to temporarily reinstate&nbsp;the law&nbsp;while appeals are ongoing,&nbsp;reversing&nbsp;a lower court\u2019s ruling that had&nbsp;<a title=\"This external link will open in a new window\" href=\"https:\/\/www.breitbart.com\/politics\/2021\/10\/06\/obama-appointed-judge-blocks-texas-law-banning-abortion-six-weeks-pregnancy\/\" target=\"_blank\" rel=\"noopener noreferrer\">blocked<\/a>&nbsp;enforcement of the pro-life law. Abortion providers have claimed the law heavily reduced abortion access and goes against Supreme Court precedent set by&nbsp;<em>Roe v. Wade<\/em>&nbsp;in 1973. Woke&nbsp;<a href=\"https:\/\/www.breitbart.com\/politics\/2021\/09\/21\/over-50-companies-sign-letter-claiming-tx-abortion-ban-threatens-health-workers\/\">companies<\/a>,&nbsp;<a href=\"https:\/\/www.breitbart.com\/entertainment\/2021\/10\/03\/jennifer-lawrence-holds-pro-abortion-sign-next-to-her-baby-bump-at-nyc-rally-with-amy-schumer\/\">celebrities<\/a>,&nbsp;and leftist&nbsp;<a href=\"https:\/\/www.breitbart.com\/politics\/2021\/10\/05\/pennsylvania-democrat-introduce-forced-vasectomy-bill-response-texas-pro-life-law\/\">politicians<\/a>&nbsp;alike have expressed outrage at Texas\u2019s pro-life law as an attempt by Republicans to control women\u2019s bodies.&nbsp;Pro-life organizations, in contrast, have&nbsp;<a href=\"https:\/\/www.breitbart.com\/faith\/2021\/09\/06\/texas-bishops-celebrate-every-life-saved-by-heartbeat-law\/\">celebrated<\/a>&nbsp;the Texas Heartbeat Act for recognizing and protecting the personhood of unborn children.<\/p>\n<p>The State of Texas has&nbsp;<a class=\"x5l\" href=\"https:\/\/www.politico.com\/news\/2021\/10\/21\/texas-supreme-court-abortion-ban-516505\" target=\"_blank\" rel=\"noopener external\">asked the Supreme Court<\/a>,&nbsp;\u201cif it reaches merits,\u201d to consider overturning<em>&nbsp;Roe v. Wade<\/em>&nbsp;and&nbsp;<em>Planned Parenthood v. Casey<\/em>, both decisions which declared abortion to be protected by the U.S. Constitution. The Court has not commented on Texas\u2019s request, though another case concerning Mississippi\u2019s pro-life legislation, which is set to be heard in December, <a href=\"https:\/\/www.breitbart.com\/politics\/2021\/10\/04\/abortion-religion-gun-rights-top-5-supreme-court-cases-follow-term\/\">directly challenges<\/a> those precedents.<\/p>\n<p>The case is&nbsp;<i>Whole Woman\u2019s Health v.
