Cooper<\/a>&nbsp;\u201clifted an automatic stay of his decision \u2026 that Republican Gov. Ron DeSantis and state education officials exceeded their authority by imposing the blanket ban through executive order and tagging defiant pro-mask local school boards with financial penalties\u201d after initially&nbsp;<a class=\"x5l\" title=\"This external link will open in a new window\" href=\"https:\/\/lawandcrime.com\/covid-19-pandemic\/judge-rules-against-florida-gov-ron-desantiss-order-ban-on-mask-mandates-in-schools-does-not-meet-constitutional-muster\/\" target=\"_blank\" rel=\"noopener noreferrer\">blocking<\/a> the order in August. This series of actions led DeSantis to&nbsp;<a class=\"x5l\" title=\"This external link will open in a new window\" href=\"http:\/\/onlinedocketsdca.flcourts.org\/DCAResults\/CaseDocket?Searchtype=Case+Number&amp;Court=1&amp;CaseYear=2021&amp;CaseNumber=2685\" target=\"_blank\" rel=\"noopener noreferrer\">file<\/a> an emergency appeal to the First District Court of Appeals in Tallahassee, requesting a stay, which it ultimately <a title=\"This external link will open in a new window\" href=\"https:\/\/www.breitbart.com\/politics\/2021\/09\/10\/desantis-win-appeals-court-overrules-judges-block-mask-mandate-ban-schools\/\" target=\"_blank\" rel=\"noopener noreferrer\">granted<\/a>.<\/p>\n<figure id=\"D-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"M-ROS-B1\" class=\"a8d\"><\/figure>\n<figure id=\"gmxrevmore\" class=\"H\"><\/figure>\n<p>The DeSantis administration scored another win Wednesday after the court explained why the Leon County judge was wrong. The appellate court explained it reinstated the stay because it \u201cconcluded that the appellees failed to carry their burden of demonstrating that they are likely to prevail on the merits.\u201d<\/p>\n<p>The court continued:<span class=\"Apple-converted-space\">&nbsp;<\/span><\/p>\n<blockquote readability=\"8\">\n<p>Indeed, we had serious doubts about the appellees\u2019 standing to bring the underlying lawsuit and the trial court\u2019s authority to require the education Defendants to follow (or \u2018enforce\u2019) the executive order only insofar that doing so did not violate the statutory Parents\u2019 Bill of Rights.<\/p>\n<\/blockquote>\n<p>The court said it is \u201cunlikely\u201d the appellees \u201ccan establish standing for at least three reasons,\u201d one of them being that the appellees \u201cchallenged the alleged \u2018usurpation\u2019 of authority from the local school boards and DOH.\u201d<\/p>\n<figure id=\"M-ROS-B2\" class=\"a8d\"><\/figure>\n<p>\u201cThose entities alone must advance their own institutional rights,\u201d it wrote.<span class=\"Apple-converted-space\">&nbsp;<\/span><\/p>\n<p>The court also said the appellees \u201clikely lack standing because the executive order did to appear to take any state action against them.\u201d And finally, the court said the stated purpose for bringing the lawsuit \u201cwas to safeguard the health and welfare of public-school students and the general public from the spread of the COVID-19 virus.\u201d<\/p>\n<p>\u201cBut this allegation demonstrated a speculative injury that was not redressable by the trial court. Accordingly, the appellees did not appear to have \u2018demonstrated any concrete, palpable injury sufficient to confer standing,\u201d it wrote.<span class=\"Apple-converted-space\">&nbsp;<\/span><\/p>\n<blockquote readability=\"19\">\n<p>While the Parents\u2019 Bill of Rights undoubtedly played a role in the governor\u2019s issuance of the executive order\u2014and was even pleaded as an affirmative defense\u2014the [Plaintiffs] never sought relief in their complaint based on an alleged violation of the Parents\u2019 Bill of Rights. They certainly never requested an injunction against a state administrative actor proceeding in some way in contravention of the Parents\u2019 Bill of Rights.<\/p>\n<p>\u2026<\/p>\n<p>Despite the absence of any allegation that a state administrative actor was breaching\u2014or planning to breach\u2014the Parents\u2019 Bill of Rights, the trial court still ordered the Education Defendants not to. That is, the trial court appeared to have awarded relief that was not requested, based on a theory that was not pleaded. It appeared to us, then, that the trial court issued an injunction that it did not have authority to issue, because the injunction was predicated on matters \u201c\u2018wholly outside\u2019\u201d the [Plaintiffs\u2019] causes of action.<\/p>\n<\/blockquote>\n<p>Ultimately, the court concluded that the trial court \u201cabused its discretion by vacating the automatic stay in the face of some clear doubts about the appellees\u2019 ultimate success in this appeal.\u201d<\/p>\n<p>\u201cWe in turn quashed the vacated and reinstated the automatic stay,\u201d the court added.<span class=\"Apple-converted-space\">&nbsp;<\/span><\/p>\n<p><span class=\"Apple-converted-space\">The full appeal is still pending, but DeSantis\u2019s office said the ruling \u201c<\/span>shows that the Plaintiffs have little chance of saving the trial court\u2019s ruling, so this is a win for Governor DeSantis and parents\u2019 rights in Florida!\u201d<\/p>\n<p>The case is <em>Scott v.
