For the most part, people are arguing for an exemption. The core question should be \u201c<em>Does the Federal Government have the legal authority to issue a vaccine mandate?<\/em>\u201d\u00a0 In a word, no.<\/p>\n<p><em>State Vaccine Mandates Can be Permissible<\/em><\/p>\n<p>The foundational and still-controlling legal authority is <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/197\/11\/\"><em>Jacobson v. Mass<\/em>, 197 U.S. 11 (1905)<\/a>.\u00a0 In that case, the U.S. Supreme Court let stand a vaccine mandate issued by a town.\u00a0 The Court reasoned that the town\u2019s legal authority flowed from the State\u2019s general <a href=\"https:\/\/www.law.cornell.edu\/wex\/police_powers\">police powers<\/a>.\u00a0 Massachusetts law empowered local boards of health to mandate vaccines for when a contagious disease has an outbreak.\u00a0 During a Small Pox outbreak, the Cambridge board of health mandated that all adults who were fit candidates had to be vaccinated or pay a $5 fine. The Supreme Court found that the concern about an outbreak of a deadly and contagious disease justified this use of the state\u2019s police powers.<\/p>\n<p>The Court acknowledged the states\u2019 inherent police power regarding public health and discussed why Massachusetts\u2019 mandatory vaccination law was reasonable.\u00a0 It found the small pox vaccine \u201cstrongly tends to prevent the transmission or spread of this disease\u2026\u201d but conceded not everyone believed the vaccine prevented the disease, however it was generally held to have the \u201cdecided tendency to prevent the spread of this fearful disease and to render it less dangerous to those who contract it.\u201d <em>Jacobson at<\/em> 34 (quoting <em>Matter of Viemeister v. White<\/em>, 88 A.D. 44, 84 N.Y.S. 712 (N.Y. App Div. 1903)<a href=\"applewebdata:\/\/9abd2b65-b373-4758-953f-7c912c86d649#_ftn1\" name=\"_ftnref1\">[1]<\/a>.<\/p>\n<p class=\"article-extras trending\"><strong>TRENDING:<\/strong> <a href=\"https:\/\/www.thegatewaypundit.com\/2021\/10\/concerned-mother-wants-air-tv-ad-pfizers-dangerous-vaccine-daughter-severely-permanently-damaged-comcast-refuses-ad-last-minute\/\" data-type=\"Internal link\" data-type-location=\"in-content-trending\">Concerned Mother Wants to Air TV Ad on Pfizer&#8217;s Dangerous Vaccine After Daughter Is Severely and Permanently Damaged &#8212; But Comcast Refuses Ad at Last Minute<\/a><\/p>\n<p>The <a href=\"https:\/\/www.law.cornell.edu\/constitution\/tenth_amendment\">Tenth Amendment<\/a>, though often ignored or neglected, explicitly excludes powers to the federal government that are not granted to it in the Constitution (or implied by the powers that are granted), the effect is that the federal government does not have general \u201cpolice powers\u201d.\u00a0 The legal phrase describing the federal government is that it has \u201climited and enumerated powers.\u201d<\/p>\n<p>The Tenth Amendment states:<\/p>\n<p><em>The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.<\/em><\/p>\n<p>Taken together, the Tenth Amendment and <em>Jacobson<\/em> leave no doubt that the ability to create vaccine mandates belongs to the states. \u00a0<strong><em>The Federal Government has NO authority to issue vaccine mandates.<\/em>\u00a0 <\/strong>A state\u2019s mandates will be upheld as long as it isn\u2019t enacted or enforced in an unreasonable, arbitrary or oppressive manner (s<em>ee Jacobson, at<\/em> 39,40), so <a href=\"https:\/\/www.reuters.com\/world\/us\/us-supreme-court-justice-rejects-challenge-maine-covid-19-vaccine-mandate-2021-10-19\/\">the Supreme Court\u2019s refusal to stop the Maine mandate<\/a> is not surprising.<\/p>\n<p><em>The Supremacy Clause Does Not Rescue Biden\u2019s Mandate<\/em><\/p>\n<p>The <a href=\"https:\/\/www.law.cornell.edu\/wex\/supremacy_clause\">Supremacy Clause<\/a> makes it crystal clear than in areas where the feds have Constitutional authority, federal law overrides any state or local law to the contrary.\u00a0 Think of it as the inverse of the Tenth Amendment.\u00a0 For a federal law (or regulation or executive order) to be \u201csupreme\u201d, it must first be Constitutionally permissible.\u00a0 A federal vaccine mandate<a href=\"applewebdata:\/\/9abd2b65-b373-4758-953f-7c912c86d649#_ftn2\" name=\"_ftnref2\">[2]<\/a> is <a href=\"https:\/\/content.next.westlaw.com\/Glossary\/PracticalLaw\/I41334c8d07ef11ebbea4f0dc9fb69570?transitionType=Default&amp;contextData=(sc.Default)&amp;firstPage=true\"><em>void ab initio<\/em><\/a>!<\/p>\n<p><em>Did Biden Issue a Vaccine Mandate?<\/em><\/p>\n<p>Biden knows he doesn\u2019t have the legal authority to issue a direct vaccine mandate, so his mandate is masquerading as a work rule to hide it behind the <a href=\"https:\/\/www.law.cornell.edu\/wex\/commerce_clause\">Interstate Commerce Clause<\/a>.\u00a0 Nevertheless, by creating a coercive choice between destitution and submission, there is no way to see his actions as anything other than an attempt to appropriate state powers that are denied to him. If \u201ca rose by any other name would smell as sweet<a href=\"applewebdata:\/\/9abd2b65-b373-4758-953f-7c912c86d649#_ftn3\" name=\"_ftnref3\">[3]<\/a>,\u201d then this is a mandate.\u00a0 This mandate-disguised-as-a-work-rule is such a cynical attempt to \u201c<a href=\"https:\/\/www.foxnews.com\/politics\/jonathan-turley-biden-ron-klain-vaccine-retweet-daft\">work around<\/a>\u201d the federal government\u2019s lack of authority to issue a mandate any federal judge should see through it.<\/p>\n<p>Jacobson <em>is old, bit it is still the law<\/em><\/p>\n<p><em>Jacobson<\/em> age implies very strong <a href=\"https:\/\/www.law.cornell.edu\/wex\/stare_decisis\">stare decisis<\/a> (think a snowball rolling down a hill). Any change would re-write the relationship between the states and the federal government, and essentially repeal the 10<sup>th<\/sup> Amendment.\u00a0 Truly, if the federal government can use the Interstate Commerce clause to decide what medicine you have to take if you want to be able to work, there is nothing to stop it from preventing you from being employable if you eat French fries, or drink alcohol, or have unprotected sex, or have too many kids, etc.<\/p>\n<p><em>It\u2019s Not About the Vaccine, It\u2019s about the Unconstitutional Order<\/em><\/p>\n<p>Biden is aware<a href=\"applewebdata:\/\/9abd2b65-b373-4758-953f-7c912c86d649#_ftn4\" name=\"_ftnref4\">[4]<\/a> the power to issue vaccine mandates rests with the states. There is no COVID exception to the Constitution.\u00a0 At the time the Constitution was drafted, the Founders were well acquainted with plagues and outbreaks of various disease.\u00a0 Such occurrences were a fact of life for them, and yet they refused to create special \u201cplague\u201d or pandemic powers for the federal government.\u00a0 Since Biden is actively attempting to over-reach the limits on his power, and subvert the explicit authority of the states, he has become an active threat to the Constitution.<\/p>\n<p>Biden\u2019s actions violate the Tenth Amendment.\u00a0 Every federal employee (and every lawyer) swears an oath to protect the Constitution. Our obligation is to oppose the mandate and all efforts by this administration to appropriate powers that belong to the states and to coerce the people. The Constitution can\u2019t protect itself.<\/p>\n<p><a href=\"applewebdata:\/\/9abd2b65-b373-4758-953f-7c912c86d649#_ftnref1\" name=\"_ftn1\">[1]<\/a> It makes one wonder, given the vaccine\u2019s poor performance in that it doesn\u2019t prevent people from catching the or spreading the disease, and its ability to mitigate the severity of the disease is questionable, would the <em>Jacobson<\/em> court have found a state COVID-19 vaccine mandate permissible.<br \/>\n<a href=\"applewebdata:\/\/9abd2b65-b373-4758-953f-7c912c86d649#_ftnref2\" name=\"_ftn2\">[2]<\/a> Conceivably, a vaccine mandate as part of a national defense situation would likely be permissible, but, unless President Biden is going to declare the pandemic to have been an act of biological warfare, which would endanger his family\u2019s revenue stream, that won\u2019t happen for COVID-19<br \/>\n<a href=\"applewebdata:\/\/9abd2b65-b373-4758-953f-7c912c86d649#_ftnref3\" name=\"_ftn3\">[3]<\/a> <em>Romeo and Juliet<\/em>, Act 2 Scene 2, Wm. Shakespeare.<br \/>\n<a href=\"applewebdata:\/\/9abd2b65-b373-4758-953f-7c912c86d649#_ftnref4\" name=\"_ftn4\">[4]<\/a> To the extent that he is aware of anything.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Many people are objecting to the mandate to get vaccinated and there are a number of lawsuits working through the courts.
