His legislative plan eventually won over the existing court, however, and the Senate struck down his attempt to expand the court. <strong><a href=\"https:\/\/dailycaller.com\/2021\/04\/15\/biden-supreme-court-packing-bonehead-idea\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: FLASHBACK: Biden Called Packing The Court A \u2018Bonehead\u2019 Idea)<\/a><\/strong><\/p>\n<p>After then-Senate Majority Leader Mitch McConnell denied a hearing in 2016 to then-Supreme Court nominee Merrick Garland following the death of Justice Antonin Scalia, Democrats began to argue that, in doing so, Republicans were effectively \u201cpacking the court.\u201d Those cries got louder when former President Donald Trump got to make two more appointments to the high court \u2014 Justices Brett Kavanaugh and Amy Coney Barrett \u2014 the latter of whom was appointed and confirmed just days before the 2020 presidential election.<\/p>\n<p>The issue took over the final weeks of the campaign as reporters on both sides of the aisle asked President Joe Biden and Vice President Kamala Harris whether they planned to pack the court \u2013 and both responded in ways that indicated they were aware how unpopular the issue was with most Americans. Even liberal Justices <a href=\"https:\/\/dailycaller.com\/2021\/09\/10\/stephen-breyer-court-packing-goes-around-comes-around\/\" target=\"_blank\" rel=\"noopener noreferrer\">Stephen Breyer<\/a> and the late <a href=\"https:\/\/dailycaller.com\/2019\/07\/24\/ruth-bader-ginsburg-court-packing\/\" target=\"_blank\" rel=\"noopener noreferrer\">Ruth Bader Ginsburg<\/a> voiced opposition to the idea.<\/p>\n<p>Biden did not directly answer the question, saying that he did not want to make the election about that particular issue, but he did say that he would address the issue after he was elected.<\/p>\n<blockquote class=\"twitter-tweet\" readability=\"6.3165137614679\">\n<p dir=\"ltr\" lang=\"en\">Joe Biden says he\u2019s \u201cnot a fan\u201d of court-packing and that he doesn\u2019t want to make the election about the issue <a href=\"https:\/\/t.co\/P142qqRhjE\">https:\/\/t.co\/P142qqRhjE<\/a> <a href=\"https:\/\/t.co\/8QMS7JcGBe\">pic.twitter.com\/8QMS7JcGBe<\/a><\/p>\n<p>\u2014 CNN Politics (@CNNPolitics) <a href=\"https:\/\/twitter.com\/CNNPolitics\/status\/1316017129770999813?ref_src=twsrc%5Etfw\">October 13, 2020<\/a><\/p>\n<\/blockquote>\n<p>Harris attempted to deflect a debate question about court-packing by fabricating a quote from former President Abraham Lincoln.<\/p>\n<blockquote class=\"twitter-tweet\" readability=\"6.9146341463415\">\n<p dir=\"ltr\" lang=\"en\">Kamala Harris Fabricated \u2018Honest Abe\u2019 Quote In History Lesson On Supreme Court Vacancies <a href=\"https:\/\/t.co\/lPYogQETFg\">https:\/\/t.co\/lPYogQETFg<\/a><\/p>\n<p>\u2014 Daily Caller (@DailyCaller) <a href=\"https:\/\/twitter.com\/DailyCaller\/status\/1314275621636313088?ref_src=twsrc%5Etfw\">October 8, 2020<\/a><\/p>\n<\/blockquote>\n<p>Even after they were sworn in, Biden\u2019s plan to have a <a href=\"https:\/\/dailycaller.com\/2021\/10\/15\/joe-biden-supreme-court-commission-divided-packing-court\/\" target=\"_blank\" rel=\"noopener noreferrer\">commission<\/a> study the possibility of expanding the court was met with animosity from Republicans and concern from Independents. A <a href=\"https:\/\/firstliberty.org\/wp-content\/uploads\/2021\/04\/National421FinalPollResults.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Mason-Dixon poll<\/a> from April, 2021, indicated that nearly three-fourths (72%) of Independents and 95% of Republicans opposed the idea that Biden could back a Democratic plan to expand the court. One-third of the Democrats surveyed also opposed the idea.<\/p>\n<p>The <a href=\"https:\/\/dailycaller.com\/2021\/04\/15\/white-house-shoots-down-court-packing-for-now\/\" target=\"_blank\" rel=\"noopener noreferrer\">Democratic plan<\/a>, which House Judiciary Committee Chairman Jerry Nadler promoted as \u201cunpacking the court,\u201d drew support from the far left.<\/p>\n<blockquote class=\"twitter-tweet\" readability=\"15.084507042254\">\n<p dir=\"ltr\" lang=\"en\">Republicans promised to overturn Roe v Wade, and they have.<\/p>\n<p>Democrats can either abolish the filibuster and expand the court, or do nothing as millions of peoples\u2019 bodies, rights, and lives are sacrificed for far-right minority rule.<\/p>\n<p>This shouldn\u2019t be a difficult decision. <a href=\"https:\/\/t.co\/GcEjkxt3gs\">https:\/\/t.co\/GcEjkxt3gs<\/a><\/p>\n<p>\u2014 Alexandria Ocasio-Cortez (@AOC) <a href=\"https:\/\/twitter.com\/AOC\/status\/1433283680181620739?ref_src=twsrc%5Etfw\">September 2, 2021<\/a><\/p>\n<\/blockquote>\n<blockquote class=\"twitter-tweet\" readability=\"12.240875912409\">\n<p dir=\"ltr\" lang=\"en\">Remember that Republicans have lost 6 of the last 7 popular votes, but have appointed 6 of the last 9 justices.<\/p>\n<p>By expanding the court we fix this broken system and have the court better represent the values of the American people.<\/p>\n<p>\u2014 Ilhan Omar (@IlhanMN) <a href=\"https:\/\/twitter.com\/IlhanMN\/status\/1320885268929482752?ref_src=twsrc%5Etfw\">October 27, 2020<\/a><\/p>\n<\/blockquote>\n<p>But Biden\u2019s commission, which returned its report on the issue earlier this month, warned that expanding the court might provide a temporary advantage with regard to the Democrats\u2019 agenda but could undermine the credibility of the court in the longer term.<\/p>\n<blockquote class=\"twitter-tweet\" readability=\"5.3781512605042\">\n<p dir=\"ltr\" lang=\"en\">Biden Supreme Court commission opposes adding justices <a href=\"https:\/\/t.co\/X9oDLPWLqd\">https:\/\/t.co\/X9oDLPWLqd<\/a><\/p>\n<p>\u2014 Fox News (@FoxNews) <a href=\"https:\/\/twitter.com\/FoxNews\/status\/1448824915109556226?ref_src=twsrc%5Etfw\">October 15, 2021<\/a><\/p>\n<\/blockquote>\n<p><a href=\"https:\/\/www.foxnews.com\/politics\/biden-supreme-court-commission-court-packing\" target=\"_blank\" rel=\"noopener noreferrer\">Discussion materials<\/a> released by the commission indicated a concern that any effort to expand the court would be seen as partisan and undermine the legitimacy proponents of the move claimed they were attempting to restore.<\/p>\n<blockquote readability=\"10\">\n<p>But the risks of Court expansion are considerable, including that it could undermine the very goal of some of its proponents of restoring the Court\u2019s legitimacy \u2026 Recent polls suggest that a majority of the public does not support Court expansion.
