The former president has repeatedly decried the investigation, and a memo issued Monday by Taylor Budowich, the Save America PAC\u2019s director of communications, called it \u201chyper-partisan and illegitimate.\u201d<\/p>\n<p>The <a href=\"https:\/\/s3.documentcloud.org\/documents\/21087682\/10-18-21-trump-v-thompson-complaint.pdf\">lawsuit<\/a>, filed in the D.C. district court, names Democratic Mississippi Rep. Bennie Thompson as a defendant. Thomson serves as the Jan. 6 committee\u2019s chair. Trump also names the committee, national archivist David Ferriero and the National Archives as defendants.<\/p>\n<p>\u201cThe United States House Select Committee to Investigate the January 6th Attack on the United States Capitol (the \u2018Committee\u2019) has decided to harass President Trump and senior members of his administration (among others) by sending an illegal, unfounded, and overbroad records request to the Archivist of the United States,\u201d the lawsuit reads. \u201cThis self-described \u2018sweeping\u2019 request is almost limitless in scope and effectively seeks every presidential record and communication that could tenuously relate to events that occurred on January 6, 2021.\u201d<\/p>\n<p>The lawsuit asks for the committee\u2019s request to be deemed invalid and also demands the National Archives be blocked from giving over documents to Congress amid the probe. Trump has said the documents are covered, citing executive privilege, though President Joe Biden\u2019s White House <a href=\"https:\/\/dailycaller.com\/2021\/10\/08\/biden-white-house-block-trump-documents-jan-6-committee\/\">previously blocked<\/a>&nbsp;the former president\u2019s request to withhold materials for this reason.<\/p>\n<p>\u201cThe Committee\u2019s request amounts to nothing less than a vexatious, illegal fishing expedition openly endorsed by Biden and designed to unconstitutionally investigate President Trump and his administration. Our laws do not permit such an impulsive, egregious action against a former President and his close advisors,\u201d the lawsuit, filed by Trump\u2019s lawyers, reads.<\/p>\n<div id=\"attachment_7304206\" class=\"wp-caption aligncenter\" readability=\"38\">\n<p id=\"caption-attachment-7304206\" class=\"wp-caption-text\">WASHINGTON, DC \u2013 JULY 27: Rep. (Photo by Brendan Smialowski-Pool\/Getty Images)<\/p>\n<\/div>\n<p>Former Trump aide Steve Bannon, another individual facing a subpoena from the committee, has refused to comply with the request and now faces potential <a href=\"https:\/\/dailycaller.com\/2021\/10\/08\/jan-6-committee-contempt-congress-subpoenas-cheney-thompson\/\">criminal contempt<\/a> charges. Biden told reporters Friday evening that the Department of Justice (DOJ) should go after those who don\u2019t comply with subpoenas, adding that he hopes \u201cthe committee goes after them and holds them accountable.\u201d<\/p>\n<p>The president\u2019s comments spurred damage control from the administration, with White House press secretary Jen Psaki tweeted shortly afterwards that Biden \u201csupports the work of the committee and the independent role of the Department of Justice to make any decisions about prosecutions.\u201d<\/p>\n<p>\u201cThe Department of Justice will make its own independent decisions in all prosecutions based solely on the facts and the law. Period. Full stop,\u201d DOJ spokesman Anthony Coley sternly declared on Friday as well. <strong><a href=\"https:\/\/dailycaller.com\/2021\/10\/16\/biden-doj-prosecute-trump-officials-subpoenas-jan-6\/\">(RELATED:&nbsp;Biden Says DOJ Should Prosecute Former Trump Officials Defying Jan. 6 Subpoenas, Prompts Damage Control From Admin)<\/a><\/strong><\/p>\n<p>Psaki furthered the backtracking Monday when <a href=\"https:\/\/dailycaller.com\/2021\/10\/18\/doocy-psaki-biden-doj-subpoena-january-6\/\">pressed<\/a> on whether Biden believes those who defy subpoenas should be criminally prosecuted, as he said on Friday.
