The state\u2019s law says it is illegal to take off a condom during \u2013 not after \u2013 sex without the partner\u2019s permission.<\/p>\n<p><span><strong>Fact Check:<\/strong><\/span><\/p>\n<p>Democratic Gov. Gavin Newsom on Oct. 7 signed a bill, introduced by Assemblymember Cristina Garcia, that banned the removal of a condom during sex without the partner\u2019s permission, an act otherwise known as stealthing, according to <a href=\"https:\/\/www.bbc.com\/news\/world-us-canada-58848000\" target=\"_blank\" rel=\"noopener noreferrer\">BBC News<\/a>. California is the first state to make stealthing illegal, the outlet reported.<\/p>\n<p>Since the passage of the law, social media users have been sharing a claim that the law actually bans the removal of a condom after sexual intercourse without a partner\u2019s consent. One such Facebook post reads, \u201cCalifornia, it is now illegal for a man to remove his condom after sex WITHOUT his love partner\u2019s permission.\u201d<\/p>\n<p>That is, however, an inaccurate read of the law. Check Your Fact reviewed the bill, <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202120220AB453\" target=\"_blank\" rel=\"noopener noreferrer\">AB 453<\/a>, in its entirety and found no mention of removing a condom after sex. A wider internet search turned up <a href=\"https:\/\/www.google.com\/search?q=california+bans+condom+removal+after+sex&amp;rlz=1C5CHFA_enUS890US890&amp;source=lnms&amp;tbm=nws&amp;sa=X&amp;ved=2ahUKEwi3pf-lwczzAhUGp3IEHZV4BBsQ_AUoAXoECAEQAw&amp;biw=1420&amp;bih=706&amp;dpr=2\" target=\"_blank\" rel=\"noopener noreferrer\">no media outlets<\/a> reporting on such an inclusion in the legislation.<\/p>\n<p>Founder and president of Dordulian Law Group <a href=\"https:\/\/www.dlawgroup.com\/team-members\/samuel-dordulian\/\" target=\"_blank\" rel=\"noopener noreferrer\">Samuel Dordulian<\/a> confirmed to Check Your Fact in an email that the claim was inaccurate.<\/p>\n<p>\u201cThe claim is false,\u201d Dordulian said. \u201cIf you read the statute, it makes it illegal to cause \u2018contact\u2019 with a sexual organ, from which a condom has been removed, and an intimate part of another.
