The law has a narrow exception window for cases in which the pregnancy could endanger the mother\u2019s life, according to <a href=\"https:\/\/www.nytimes.com\/2021\/09\/01\/health\/texas-abortion-law-facts.html\" target=\"_blank\" rel=\"noopener noreferrer\">The New York Times<\/a>. It does not make exceptions for rape or incest.<\/p>\n<p>The 2-1 decision is the third decision to let the law stand.<\/p>\n<blockquote class=\"twitter-tweet\" readability=\"12.022875816993\">\n<p dir=\"ltr\" lang=\"en\">Our hearts are with our <a href=\"https:\/\/twitter.com\/ACLUTx?ref_src=twsrc%5Etfw\">@ACLUTX<\/a> colleagues tonight and the people of Texas who are facing attacks across multiple fronts, especially the Black and Brown communities disproportionately impacted by bills attacking abortion rights and trans youth.<\/p>\n<p>These fights aren\u2019t over.<\/p>\n<p>\u2014 ACLU (@ACLU) <a href=\"https:\/\/twitter.com\/ACLU\/status\/1448839765789450240?ref_src=twsrc%5Etfw\">October 15, 2021<\/a><\/p>\n<\/blockquote>\n<p>Abortion providers filed an emergency request with the Supreme Court to block the law from taking effect. The high court, however, <a href=\"https:\/\/dailycaller.com\/2021\/09\/01\/texas-abortion-ban-heartbeat-bill-goes-into-effect\/\" target=\"_blank\" rel=\"noopener noreferrer\">refused<\/a> to intervene, and the law took effect Sept. 1. Attorney General Merrick Garland <a href=\"https:\/\/dailycaller.com\/2021\/09\/09\/biden-sue-texas-abortion-report\/\" target=\"_blank\" rel=\"noopener noreferrer\">announced<\/a> Sept. 9 that the administration would sue the State of Texas over the law. <strong><a href=\"https:\/\/dailycaller.com\/2021\/10\/05\/biden-reverses-trump-rule-abortion\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Biden Reverses Trump Rule Blocking Federal Funds From Going To Abortion Businesses)<\/a><\/strong><\/p>\n<p>The DOJ <a href=\"https:\/\/dailycaller.com\/2021\/09\/15\/doj-abortion-texas-judge-filing\/\" target=\"_blank\" rel=\"noopener noreferrer\">then asked<\/a> a federal judge to block the law, calling for a temporary restraining order or injunction and arguing that the law intends \u201cto prevent women from exercising their constitutional rights.\u201d<\/p>\n<p>A federal judge <a href=\"https:\/\/dailycaller.com\/2021\/10\/06\/federal-judge-halts-texas-abortion-law\/\" target=\"_blank\" rel=\"noopener noreferrer\">halted the enforcement<\/a> of the law in early October while legal battles ensued. Texas quickly <a href=\"https:\/\/twitter.com\/steve_vladeck\/status\/1445930084699869185\/photo\/1\" target=\"_blank\" rel=\"noopener noreferrer\">appealed<\/a> the ruling to the Fifth Circuit.<\/p>\n<p>President Joe Biden has <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/statements-releases\/2021\/09\/02\/statement-by-president-joe-biden-on-supreme-court-ruling-on-texas-law-sb8\/\" target=\"_blank\" rel=\"noopener noreferrer\">criticized<\/a> the law as an \u201cunprecedented assault on a woman\u2019s constitutional rights under Roe v.
