And it is not an immigration policy. It is not an immigration policy that we in this administration would embrace. But we view it as a public health imperative as the Centers for Disease Control has so ordered,\u201d he said in a virtual interview that aired during a forum hosted in Qatar.<\/p>\n<p>\u201cWe\u2019re in the midst of a pandemic. For anyone to think it\u2019s business as usual I think would be, frankly, ignoring a pandemic that has taken more than 700,000 American lives,\u201d he added.<\/p>\n<p>Over 100 groups joined together to urge President Joe Biden over the summer to stop using Title 42, alleging it is unlawful. Some health experts have argued there\u2019s no basis for the order despite the ongoing pandemic.<\/p>\n<p>A top State Department lawyer, meanwhile, resigned earlier this month over the deportations under Biden, reportedly telling colleagues in a memorandum that the administration\u2019s use of Title 42 authority violates \u201clegal obligation not to expel or return \u2026 individuals who fear persecution, death, or torture, especially migrants fleeing from Haiti.\u201d<\/p>\n<figure id=\"attachment_4014099\" class=\"wp-caption alignnone\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/10\/Border-Del-Rio-Haitians-510A0652-1200x800-1.jpg\" width=\"1200\" height=\"800\" \/><figcaption class=\"wp-caption-text\"><noscript><img loading=\"lazy\" decoding=\"async\" class=\"size-large wp-image-4014099\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/10\/Border-Del-Rio-Haitians-510A0652-1200x800-1.jpg\" alt=\"Epoch Times Photo\" width=\"640\" height=\"427\" \/><\/noscript><\/figcaption>&nbsp;<\/p>\n<p>Haitians who crossed the U.S. border illegally and were processed by Border Patrol before being dropped at a local NGO Border Humanitarian Coalition to catch a bus to San Antonio or Houston are seen in Del Rio, Texas, on Sept. 22, 2021. (Charlotte Cuthbertson\/The Epoch Times)<\/figure>\n<p>After a flood of Haitian nationals <a href=\"https:\/\/www.theepochtimes.com\/how-the-haitian-border-crisis-under-a-del-rio-bridge-unfolded_4021592.html\">crossed the border into Texas<\/a> last month, the U.S. government <a href=\"https:\/\/www.theepochtimes.com\/camp-at-us-mexico-border-cleared-of-immigrants-officials_4015453.html\">released many of them<\/a> into the interior of the country but deported several thousand, angering immigration advocates.<\/p>\n<p>Daniel Foote, another administration official, <a href=\"https:\/\/www.theepochtimes.com\/bidens-special-envoy-to-haiti-resigns-in-protest-of-deportations_4012828.html\">stepped down last month<\/a>\u00a0over similar complaints.<\/p>\n<p>White House press secretary Jen Psaki responded to the lawyer, Harold Koh, by saying Title 42 \u201cremains in place because we\u2019re in the middle of a pandemic\u201d and does have exceptions for people who are fleeing persecution.<\/p>\n<p>Mayorkas said Koh\u2019s memo didn\u2019t trouble him but that a visit to Del Rio, where illegal immigrants overwhelmed local authorities, did.<\/p>\n<p>Mayorkas recounted seeing the immigrants in person and knowing that \u201ca number of them, a material percentage of them, will, in fact, be expelled under the Title 42 authority and these are individuals who are seeking a better life for themselves and their families.\u201d<\/p>\n<p>\u201cIt\u2019s a heartbreaking thing to see. I don\u2019t need anyone to share words to explain to me what that heartbreak is and what it means. But this is what is necessary as a matter of public health imperative as ordered by the Centers for Disease Control. And that is the authority we\u2019re executing,\u201d he added.<\/p>\n<p>Critics say the order is no longer needed because vaccinations have gone up and so have people who have recovered from COVID-19 and thus have some level of immunity against the\u00a0<a href=\"https:\/\/www.theepochtimes.com\/giving-the-right-name-to-the-virus-causing-a-worldwide-pandemic-2_3277200.html\" target=\"_blank\" rel=\"noopener\">CCP (Chinese Communist Party) virus<\/a>. Some allege the CDC never had the authority to impose immigration restrictions.<\/p>\n<p>But others argue it was necessary and remains necessary.<\/p>\n<p>\u201cTitle 42 remains essential during the COVID-19 global pandemic even though Secretary Alejandro Mayorkas has revealed that his administration does not embrace the order as an immigration policy. Without it in place or fully applied to all migrants, illegal immigration would likely increase at our southern border. As America continues its struggle against the COVID-19 pandemic, responsible border controls that diminish illegal immigration reduce the public health risks to our country,\u201d Matthew Tragesser, press secretary for the\u00a0Federation for American Immigration Reform (FAIR), told The Epoch Times via email.<\/p>\n<p>Biden upon taking office nearly immediately exempted unaccompanied minors, or illegal immigrant children, from Title 42. The administration later stopped using it to expel many family units. FAIR estimates at least half a million illegal immigrants that would have been expelled during the Trump era have been exempted.<\/p>\n<p>The administration has also <a href=\"https:\/\/www.theepochtimes.com\/dhs-to-scrap-trump-era-remain-in-mexico-program-despite-judge-orders-for-reinstatement_4024585.html\">tried avoiding<\/a> a revival of the \u201cRemain in Mexico\u201d program in defiance of a court order and stopped building portions of the wall along the southern border. It should reimplement those border initiatives, among others, to bring illegal immigration under control, Tragesser said.<\/p>\n<p>Mayorkas said he was not sure how long Title 42 authority will continue to be in place. A review determined it is still needed in light of the spread of the CCP virus\u2019s Delta variant.<\/p>\n<p>\u201cI think we are unanimous in the fact that we hope public health authorities are no longer necessary because we have the pandemic behind us.
