This dangerous federal overreach imposes a chilling effect on free speech by criminalizing dissent. I will always advocate for parents and will continue to push back against unprecedented federal overreach,\u201d Schmitt said in a press release accompanying his letter to Garland.<\/p>\n<p>As The Daily Wire <a href=\"https:\/\/www.dailywire.com\/news\/doj-fbi-investigating-disturbing-spike-in-harassment-threats-against-school-administrators\">reported<\/a> on Monday, the DOJ has \u201cordered the FBI to work on curbing \u2018harassment\u2019 and \u2018threats of violence\u2019 against school administrators after it said the number of such incidents spiked in the past year. The DOJ\u2019s move came days after the National School Boards Association (NSBA) <a href=\"https:\/\/www.nsba.org\/News\/2021\/federal-assistance-letter\">pushed<\/a> the Biden administration to take action against the rise in \u2018malice, violence, and threats,\u2019 which the association said could constitute \u2018a form of domestic terrorism and hate crimes.&#8217;\u201d<\/p>\n<p>In his <a href=\"https:\/\/ago.mo.gov\/docs\/default-source\/press-releases\/2021-10-5-ltr-doj.pdf?sfvrsn=54c36e8e_2\">letter<\/a>, Schmitt explained how the Biden administration\u2019s justification for having the FBI get involved in local matters doesn\u2019t hold up. \u201c[T]he federal government does not have jurisdiction over local school issues,\u201d Schmitt wrote, noting that the National School Boards Association asked the DOJ to use \u201cfederal anti-terrorism and anti-hate crimes laws\u201d in order to insert themselves in local matters. The NSBA, Schmitt wrote, specifically asked the DOJ to \u201cprotect interstate commerce\u201d by using the Gun-Free School Zones Act and the PATRIOT Act.<\/p>\n<p>Schmitt explained that the Supreme Court has already rejected the interstate commerce argument using the Gun-Free School Zones Act. Twenty-five years ago, in <em>United States v. Lopez<\/em>, \u201cthe federal government argued that possession of a firearm around a school could affect interstate commerce through the economic effects resulting from violence or an impacted education process.\u201d But the Supreme Court rejected this claim, ruling that \u201cif we were to accept the Government\u2019s arguments, we are hard pressed to posit any activity by an individual that Congress is without power to regulate.\u201d The Supreme Court further ruled that such a connection was unconstitutional because it \u201cneither regulates a commercial activity nor contains a requirement that the possession be connected in any way to interstate commerce.\u201d<\/p>\n<p>As Schmitt noted, neither Garland\u2019s memo nor the NSBA\u2019s letter demanding the federal government intervene in school board meetings identified \u201cany impact that parent comments to school bureaucrats could have on interstate commerce.\u201d<\/p>\n<p>Schmitt then explained how the PATRIOT Act would also fail to justify intervention in school-board meetings. \u201cIt is ridiculous to think that a law designed to prevent another 9\/11 could be used by the Biden Administration to prosecute parents who are advocating for the best interests of their kids,\u201d Schmitt wrote.<\/p>\n<p>The Missouri AG also noted that the Supreme Court just recently ruled that \u201cWhen it comes to a person\u2019s beliefs and associations, broad and sweeping state inquiries into these protected areas discourage citizens from exercising rights protected by the Constitution.\u201d<\/p>\n<p>Schmitt also insisted that the DOJ\u2019s involvement in school-board meetings is \u201cwildly inconsistent.\u201d According to Garland\u2019s memo, the DOJ \u201cis steadfast in its commitment to protect all people in the United States from violence, threats of violence, and other forms of intimidation and harassment.\u201d Yet Schmitt noted that just in the past few days, \u201cradical activists have chased Senator Krysten [sic] Sinema into a restroom and harassed her in an airport and on an airplane\u201d while other \u201cradical activists surrounded Senator Joe Manchin\u2019s houseboat on kayaks.\u201d<\/p>\n<p>Schmitt noted that President Joe Biden dismissed concerns about the harassment of these two senators by saying it\u2019s \u201cpart of the process.\u201d<\/p>\n<p>\u201cThe Justice Department has not directed the FBI and federal officials to investigate and prosecute these radical activists,\u201d Schmitt noted, adding that the Biden administration \u201chas different rules for parents trying to protect their kids and radicals trying to intimidate moderate senators.\u201d<\/p>\n<p>In closing, Schmitt wrote that the DOJ directive was an attempt to \u201cmuzzle and intimidate parents, who are their own children\u2019s best advocates.\u201d<\/p>\n<p>\u201cAs elected officials, school board members are directly accountable to the voters \u2013 parents \u2013 they represent. School boards are designed to receive and reflect parent input. Board meetings are supposed to be open to the public with the opportunity for public comment by parents,\u201d Schmitt wrote. \u201cBut now that parents are opposing harmful decisions made by school boards, school boards want to treat parents as domestic terrorists.
