As The Daily Wire previously&nbsp;<a href=\"https:\/\/www.dailywire.com\/news\/supreme-court-rejects-abortion-providers-request-to-stay-texas-heartbeat-law\"><span class=\"s1\">reported<\/span><\/a>, \u201cThe Texas law allows citizens to sue abortion providers and those who \u2018aid and abet\u2019 illegal procedures for a financial reward if the lawsuit is successful.\u201d<\/p>\n<p class=\"p1\">As <a href=\"https:\/\/www.npr.org\/2021\/10\/01\/1041607684\/texas-abortion-law-federal-judge\"><span class=\"s1\">reported<\/span><\/a> by NPR, \u201cDepartment attorneys and lawyers for the state of Texas made their cases on Friday at a virtual hearing before Judge Robert Pitman of the U.S. District Court for the Western District of Texas.\u201d<\/p>\n<p class=\"p1\">At the hearing, which lasted three hours, both sides gave their arguments.<span class=\"Apple-converted-space\">&nbsp;<\/span><\/p>\n<p class=\"p1\">\u201cThe state resorted to an unprecedented scheme of vigilante justice that was designed to scare abortion providers,\u201d argued Brian Netter, a lawyer for the Justice Department. \u201cSo far, it\u2019s working. Women have been left desperate, forced under sometimes harrowing circumstances to get out of Texas, if they even can.\u201d<span class=\"Apple-converted-space\">&nbsp;<\/span><\/p>\n<p class=\"p1\">\u201cA state may not ban abortions at six weeks. Texas knew this, but it wanted a six-week ban anyway, so the state resorted to an unprecedented scheme of vigilante justice that was designed to scare abortion providers and others who might help women exercise their constitutional rights,\u201d Brian Netter also <a href=\"https:\/\/apnews.com\/article\/texas-abortion-law-court-a7961b629e913e1008f8e929c99fb310\"><span class=\"s1\">said<\/span><\/a> to the court.<\/p>\n<p class=\"p1\">According to previous reporting by&nbsp;<a href=\"https:\/\/www.nytimes.com\/2021\/09\/01\/health\/texas-abortion-law-facts.html\"><span class=\"s1\">The New York Times<\/span><\/a>:<\/p>\n<blockquote readability=\"15\">\n<p class=\"p1\"><i>The Texas law bars state officials from actually enforcing it, a design intended to make it difficult to challenge in the courts.&nbsp;<\/i><\/p>\n<p class=\"p1\"><i>Usually a lawsuit aiming to block such a law as unconstitutional names state officials as defendants. Instead, the Texas law deputizes private citizens to sue anyone who performs an abortion or \u201caids and abets\u201d a procedure. Plaintiffs who have no connection to the patient or the clinic may sue and recover legal fees, as well as $10,000 if they win.<span class=\"Apple-converted-space\">&nbsp;<\/span><\/i><\/p>\n<\/blockquote>\n<p class=\"p1\">Texas lawyer Will Thompson <a href=\"https:\/\/www.washingtonpost.com\/politics\/courts_law\/texas-abortion-austin-hearing\/2021\/09\/30\/e6fafc8c-2220-11ec-9309-b743b79abc59_story.html\"><span class=\"s1\">said<\/span><\/a> at the hearing, \u201cI don\u2019t think the state went to particularly unusual lengths,\u201d as he pressed the judge to dismiss the federal government\u2019s legal action.<\/p>\n<p class=\"p1\">Thompson also <a href=\"https:\/\/www.npr.org\/2021\/10\/01\/1041607684\/texas-abortion-law-federal-judge\"><span class=\"s1\">said<\/span><\/a>, \u201cI\u2019m sorry to see that the federal government\u2019s pattern of hyperbole and inflammatory rhetoric has continued.\u201d<\/p>\n<p class=\"p1\">He also <a href=\"https:\/\/apnews.com\/article\/texas-abortion-law-court-a7961b629e913e1008f8e929c99fb310\">said<\/a>, \u201cThis is not some kind of vigilante scheme,\u201d adding, \u201cThis is a scheme that uses the normal, lawful process of justice in Texas.\u201d<\/p>\n<p class=\"p1\">NPR further reported:<\/p>\n<blockquote readability=\"12\">\n<p class=\"p1\"><i>To the Justice Department, the judge asked about any possible limits to the broad authority the federal government is claiming to sue the state. To Texas, Pitman wondered, \u201cIf the state\u2019s so confident\u201d about the constitutionality of the limits on women\u2019s access to abortion, \u201cwhy did it go to such great lengths\u201d to fashion a private right to sue?<\/i><\/p>\n<\/blockquote>\n<p class=\"p1\">The judge extended thanks to both parties and said he would consider the matters, but did not offer a timeline for when he would make a decision.<span class=\"Apple-converted-space\">&nbsp;<\/span><\/p>\n<p class=\"p1\">\u201cWe will get to work on the appropriate order in this case,\u201d Pitman said. \u201cHave a great rest of the day and weekend.\u201d<span class=\"Apple-converted-space\">&nbsp;<\/span><\/p>\n<p class=\"p1\">The Washington Post <a href=\"https:\/\/www.washingtonpost.com\/politics\/courts_law\/texas-abortion-austin-hearing\/2021\/09\/30\/e6fafc8c-2220-11ec-9309-b743b79abc59_story.html\">reported<\/a>:<\/p>\n<div class>\n<div data-qa=\"drop-cap-letter\" readability=\"7\">\n<blockquote readability=\"7\">\n<p class=\"font--article-body font-copy gray-darkest ma-0 pb-md\" data-el=\"text\"><em>Even if Pitman decides to issue an injunction after the hearing Friday, it may not provide the legal protection physicians are seeking to once again perform abortions in Texas.<\/em><\/p>\n<\/blockquote>\n<\/div>\n<\/div>\n<div class>\n<div data-qa=\"drop-cap-letter\" readability=\"7.5\">\n<blockquote readability=\"8\">\n<p class=\"font--article-body font-copy gray-darkest ma-0 pb-md\" data-el=\"text\"><em>If an injunction is later dissolved on appeal, lawsuits can still be brought retroactively, up to four years after the abortion at issue has been performed.<\/em><\/p>\n<\/blockquote>\n<\/div>\n<\/div>\n<p class=\"p1\">The Biden administration got involved in blocking the Texas law, <a href=\"https:\/\/www.dailywire.com\/news\/biden-admin-sues-texas-for-law-protecting-unborn-babies-with-heart-activity-clearly-unconstitutional\"><span class=\"s1\">announcing<\/span><\/a>&nbsp;earlier this month that it was taking legal action against the state.<span class=\"Apple-converted-space\">&nbsp;<\/span><\/p>\n<p class=\"p1\">\u201cIt is settled constitutional law that \u2018a State may not prohibit any woman from making the ultimate decision to terminate her pregnancy before viability,\u2019\u201d U.S. attorneys reportedly said in the lawsuit. \u201cBut Texas has done just that.\u201d<span class=\"Apple-converted-space\">&nbsp;<\/span><\/p>\n<p class=\"p1\">The lawsuit&nbsp;<a href=\"https:\/\/s.wsj.net\/public\/resources\/documents\/DOJ%20Texas%20lawsuit.pdf\"><span class=\"s1\">added<\/span><\/a>&nbsp;that the federal government was bringing the suit \u201cto protect other federal interests that S.B. 8 unconstitutionally impairs.\u201d<span class=\"Apple-converted-space\">&nbsp;<\/span><\/p>\n<p class=\"p1\">It argued that the law \u201cconflicts with federal law by purporting to prohibit federal agencies from carrying out their responsibilities under federal law related to abortion services.\u201d<span class=\"Apple-converted-space\">&nbsp;<\/span><\/p>\n<p class=\"p1\">\u201cBecause S.B. 8 does not contain an exception for cases of rape or incest, its terms purport to prohibit the federal government and its employees and agents from performing, funding, reimbursing, or facilitating abortions in such cases,\u201d it added.<span class=\"Apple-converted-space\">&nbsp;<\/span><\/p>\n<p class=\"p1\">The Texas filing reportedly&nbsp;<a href=\"https:\/\/www.texastribune.org\/2021\/09\/30\/texas-abortion-law-legal-challenges\/\"><span class=\"s1\">said<\/span><\/a>, \u201cIf the Department of Justice wants to expand its authority, it should direct its requests to Congress, not this Court.\u201d<span class=\"Apple-converted-space\">&nbsp;<\/span><\/p>\n<p class=\"p1\">The Supreme Court previously&nbsp;<a href=\"https:\/\/www.dailywire.com\/news\/supreme-court-rejects-abortion-providers-request-to-stay-texas-heartbeat-law\"><span class=\"s1\">chose<\/span><\/a>&nbsp;not to stay the new law, allowing it to take effect.
