Jim Jordan, ranking member of the House Judiciary Committee, told the Daily Caller News Foundation, describing her tenure as chair as \u201cradical and partisan.\u201d<\/strong><\/li>\n<li><strong>Republican FTC Commissioners Noah Phillips and Christine Wilson have accused Khan of favoring \u201cunchecked regulatory power over guidance,\u201d characterizing the withdrawal of vertical merger guidelines as a way for Khan to force businesses to subject themselves to her discretionary authority.<\/strong><\/li>\n<li><strong>Khan is ruffling feathers among rank-and-file FTC employees as well, with several recruiters and law firms reporting an unprecedented exodus of FTC lawyers since the start of Khan\u2019s tenure, and many employees saying they feel disrespected and ignored by Khan\u2019s isolated managerial style.<\/strong><\/li>\n<\/ul>\n<p>After only three months at the helm of the Federal Trade Commission, Lina Khan is disturbing many top Republicans, who say she\u2019s turned the agency into a partisan weapon.<\/p>\n<p>The 32-year-old Yale alum, <a href=\"https:\/\/dailycaller.com\/2021\/06\/15\/senate-confirms-lina-khan-lead-ftc\/\"><u>confirmed<\/u><\/a> in June with significant bipartisan support, has pushed to expand the role of the Federal Trade Commission (FTC) as well as empower her own office, withdrawing key guidelines on competition and mergers, pushing to expand rulemaking authority and overseeing antitrust litigation against Facebook, all while curbing the flow of information to the agency\u2019s staff and even fellow commissioners. Khan\u2019s actions have earned her the <a href=\"https:\/\/www.warren.senate.gov\/oversight\/letters\/new-ftc-chair-khan-shares-warrens-concerns-about-giant-defense-industry-mergers\"><u>backing<\/u><\/a>&nbsp;of several top Democrats, but some Republicans say Khan\u2019s reforms are little more than a partisan power grab.<\/p>\n<p>\u201cShe\u2019s abandoned long-standing bipartisan practices and made it clear she will use the FTC to advance President Biden\u2019s agenda in the name of economic \u2018inequality\u2019 and socialism,\u201d Rep. Mike Lee, who chairs the Senate Judiciary Committee\u2019s antitrust subcommittee, echoed Jordan\u2019s thoughts in a July <a href=\"https:\/\/www.lee.senate.gov\/2021\/7\/sen-lee-urges-ftc-to-change-course\"><u>letter<\/u><\/a>&nbsp;to Khan. Lee pointed to the diminished role of Republican commissioners in antitrust enforcement and characterized Khan\u2019s actions as \u201ca progressive putsch to consolidate power and burden American businesses.\u201d<\/p>\n<p>Republican FTC commissioners Noah Phillips and Christine Wilson have voiced similar concerns, accusing Khan of attempting to cut them out of important decisions and restricting their access to information. <strong><a href=\"https:\/\/dailycaller.com\/2021\/06\/30\/amazon-federal-trade-commission-the-wall-street-journal-lina-khan\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Amazon Wants FTC Chair And Big Tech Critic Lina Khan Recused From Antitrust Investigations Into The Company)<\/a><\/strong><\/p>\n<p>In <a href=\"https:\/\/www.ftc.gov\/system\/files\/documents\/public_statements\/1596880\/commissioner_wilson_hearing_on_reviving_competition_part_4_-_21st_century_antitrust_reforms_and_the.pdf\"><u>testimony<\/u><\/a>&nbsp;before the Senate on Tuesday, Wilson said Khan was tearing down \u201cthe FTC\u2019s rich bipartisan tradition\u201d and damaging the agency\u2019s reputation. Wilson <a href=\"https:\/\/www.ftc.gov\/system\/files\/documents\/public_statements\/1595685\/wilson_second_request_copy_letter_clarivate.pdf\"><u>alleged<\/u><\/a>&nbsp;Khan was keeping her in the dark in certain merger review cases, saying she had to ask the companies she was reviewing for documents related to the merger review process because internal FTC sources would not provide them.<\/p>\n<p>The commissioners have also taken issue with Khan\u2019s mid-September <a href=\"https:\/\/www.ftc.gov\/system\/files\/documents\/public_statements\/1596388\/p810034phillipswilsonstatementvmgrescission.pdf\"><u>withdrawal<\/u><\/a> of the 2020 Vertical Merger Guidelines, which were designed to provide clarity to businesses seeking to acquire other non-competing businesses in the same industry, without proposing a replacement. Phillips and Wilson also highlighted the conspicuous absence of public input in Khan\u2019s decisions.<\/p>\n<p>The Republicans\u2019 rebuke echoed earlier <a href=\"https:\/\/www.ftc.gov\/system\/files\/documents\/public_statements\/1591710\/p210100phillipswilsondissentsec5enforcementprinciples.pdf\"><u>criticism<\/u><\/a> of Khan for jettisoning bipartisan Obama-era guidelines on unfair competition in July and offering only a promise of future rules in their place. (Photo by Anna Moneymaker\/Getty Images)<\/p>\n<\/div>\n<p>Darren Tucker, a lawyer for antitrust law practice Vinson &amp; Elkins LLP, shed light on this practice in an open commission meeting on Sept. 15, saying FTC staff had requested information on these concerns but had not communicated how it would affect the merger review process, \u201cleaving the outside world guessing as to the role they play in agency decision making.\u201d<\/p>\n<p>Antitrust law firms said they were seeing an uptick in requests for information on the aforementioned concerns, <a href=\"https:\/\/www.law360.com\/articles\/1425218\"><u>Law360<\/u><\/a>&nbsp;reported, and Tucker told the publication that requests for this information were \u201cunusual\u201d and \u201cnontraditional.\u201d<\/p>\n<p>When reached for comment by the DCNF, an FTC spokesperson declined to provide details on how information related to ESG goals, equity concerns, and unionization would be used to determine whether a merger was lawful.<\/p>\n<p>\u201cThe FTC should be providing regulatory clarity, enforce the law as written and promote markets that consumers need to work for them,\u201d Jonathan Wilcox, spokesman for Rep. (Photo by Ting Shen-Pool\/Getty Images)<\/p>\n<\/div>\n<p>Former FTC acting Commissioner Rebecca Kelly Slaughter, a Democrat, has repeatedly and publicly <u>lobbied<\/u>&nbsp;for the FTC to consider equity concerns when enforcing antitrust law, <a href=\"https:\/\/twitter.com\/rkslaughterftc\/status\/1303762111433265153?lang=en\"><u>tweeting<\/u><\/a>&nbsp;in September 2020 that \u201cantitrust can and should be antiracist.\u201d<\/p>\n<p>\u201cAntitrust law itself can be used to promote racial inclusion and equity,\u201d Slaughter <a href=\"https:\/\/www.ftc.gov\/system\/files\/documents\/public_statements\/1583714\/slaughter_remarks_at_gcr_interactive_women_in_antitrust.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">said<\/a> at an antitrust conference in November 2020. <strong><a href=\"https:\/\/dailycaller.com\/2021\/07\/02\/amy-klobuchar-mike-lee-ken-buck-federal-trade-commission-lina-khan-facebook\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Mike Lee, Klobuchar Urge FTC To \u2018Consider All Available Options\u2019 Against Facebook)<\/a><\/strong><\/p>\n<p>Khan has not publicly addressed how information on equity concerns will affect merger reviews, but <a href=\"https:\/\/dailycaller.com\/2021\/09\/24\/lina-khan-federal-trade-commission-facebook-apple\/\"><u>issued<\/u><\/a>&nbsp;a memo last week promising to \u201ctake a holistic approach to identifying harms\u201d when enforcing antitrust and consumer protection laws.<\/p>\n<p>More recently, Khan has reportedly looked into <a href=\"https:\/\/www.wsj.com\/articles\/ftc-weighs-new-online-privacy-rules-11632913200\"><u>crafting<\/u><\/a> data privacy protections absent any federal data law, a move publicly condemned as imprudent and overreaching by Phillips, along with Republicans Sen. Roger Wicker and Rep.
