Daniel Robert and Marine Corps Staff Sgt. Hollie Mulvihill filed a lawsuit on August 17 seeking an exemption for service members who have already contracted and recovered from COVID-19, according to <a href=\"https:\/\/www.military.com\/daily-news\/2021\/09\/29\/us-troops-go-court-seeking-vaccine-exemption-those-whove-had-covid-19.html\">Military.com<\/a>.<\/p>\n<p>\u201cService members that have natural immunity, developed from surviving the virus, should be granted a medical exception from compulsory vaccination because the DoD instruction policy reflects the well-established understanding that prior infection provides the immune system\u2019s best possible response to the virus,\u201d the lawsuit states.<\/p>\n<p>The pair filed a request for an injunction to block the vaccine mandate last week as the Pentagon moves forward with vaccinating all unvaccinated service members.<\/p>\n<p>\u201cThese are the healthiest people on the planet in their age group \u2026 so why are we rushing? What is the compelling reason forcing the military to say, \u2018You must take this vaccine, regardless of what the law says?\u2019\u201d the servicemen\u2019s attorney Todd Callender said.<\/p>\n<p>Defense Secretary Lloyd Austin <a href=\"https:\/\/www.dailywire.com\/news\/pentagon-announces-vaccine-mandate-for-u-s-military\">issued<\/a> a memo on August 10 mandating that every U.S. service member be vaccinated against COVID-19 as soon as a vaccine was approved by the Food and Drug Administration (FDA) beyond the emergency use authorization the vaccines have been distributed under. The FDA approved the first vaccine, the Pfizer-BioNTech COVID-19 vaccine, on August 23.<\/p>\n<p>Two days after the vaccine\u2019s approval, Austin sent out another memo <a href=\"https:\/\/www.dailywire.com\/news\/pentagon-chief-demands-ambitious-covid-19-vaccine-mandate-timeline\">ordering<\/a> the vaccination process to begin \u201cimmediately.\u201d A possibility exists for service members to get a religious exemption to the vaccine, though anyone denied the exemption and who still refuses to get vaccinated will be relieved of duty.<\/p>\n<p>Last week, a group of GOP senators introduced a bill that would prevent the military from dishonorably discharging service members who refuse to take the vaccine. As <a href=\"https:\/\/www.dailywire.com\/news\/gop-senators-move-to-protect-military-from-dishonorable-discharges-under-biden-vaccine-order\">The Daily Wire<\/a> reported:<\/p>\n<blockquote readability=\"32.731707317073\">\n<p><em>Last week, GOP Sens. Ted Cruz (TX), James Lankford (OK), and Roger Marshall (KS)&nbsp;<a href=\"https:\/\/www.businessinsider.com\/service-members-honorable-discharge-gop-bill-refuse-covid-vaccine-cruz-2021-9\">introduced<\/a>&nbsp;the&nbsp;\u201cCOVID-19 Vaccine Dishonorable Discharge Prevention Act,\u201d seeking to block any attempts to dishonorably discharge U.S. Military members who refuse the vaccine.<\/em><\/p>\n<p><em>\u201c[A] member of an Armed Force under the jurisdiction of the Secretary of a military department subject to discharge on the basis of the member choosing not to receive the COVID\u201319 vaccine may only receive an honorable discharge,\u201d the bill text reads.<\/em><\/p>\n<p><em>\u201cIt\u2019s an insult to our servicemen and women who have served with honor to dishonorably discharge them for refusing the COVID vaccine,\u201d Cruz said. \u201cIt is the same way we dishonorably discharge those convicted of serious crimes such as treason, desertion, sexual assault, and murder.\u201d<\/em><\/p>\n<p><em>Marshall noted that a dishonorable discharge would strip a service member of their Second Amendment rights and other opportunities.<\/em><\/p>\n<p><em>\u201cTo have a dishonorable discharge will take away your Second Amendment, it\u2019s going to keep you from accessing the educational opportunities the military affords as well as access to the VA for your healthcare.
