(Jim Watson\/AFP via Getty Images)<\/p>\n<\/div>\n<p>On Sept. 9, Biden <a href=\"https:\/\/dailycaller.com\/2021\/09\/09\/joe-biden-vaccine-not-personal-choice-mandate-vaccine\/\">authorized<\/a> the Occupational Safety and Health Administration (OSHA) to craft a rule requiring businesses with more than 100 employees to mandate workers to either get a COVID-19 vaccine or submit weekly tests proving they aren\u2019t infected with the virus. It is unclear if the rule, which hasn\u2019t yet been published, will include a requirement that employers pay for the weekly tests.<\/p>\n<p>More than 80 million Americans, or <a href=\"https:\/\/fred.stlouisfed.org\/series\/PAYEMS\">over half<\/a> of the U.S. working population, work for a business that has more than 100 employees, <a href=\"https:\/\/www.bls.gov\/web\/cewbd\/table_f.txt\">according<\/a> to Bureau of Labor Statistics data.<\/p>\n<p>Eisenmann, who primarily represents employers on labor and employment issues, added that Biden\u2019s order may have the effect of helping businesses who wanted to issue a vaccine mandate, but didn\u2019t, fearing workers would leave for a different job. Because of its breadth, the rule evens the playing field and limits the options for workers seeking to quit, he said.<\/p>\n<h3><strong>\u2018Not acceptable\u2019<\/strong><\/h3>\n<p>Several labor unions, however, have forcefully condemned vaccine mandates, which they said stripped workers of their civil liberties. Many have warned of major consequences including potential mass resignations.<\/p>\n<p>\u201cAny staffing shortage, especially during a pandemic, is a threat to the health and safety of both students and personnel,\u201d Mark Cannizzaro, president of New York City\u2019s largest union representing school administrators and principals, said in a statement Thursday.<\/p>\n<p>\u201cIt is dangerous and irresponsible for the city to move forward with its plan to allow schools and centers to operate so severely understaffed,\u201d he continued. \u201cAs a result, we are calling on the city to delay the deadline for the mandate to allow the city to develop a reasonable contingency plan.\u201d<\/p>\n<p>In July, Mayor Bill de Blasio <a href=\"https:\/\/dailycaller.com\/2021\/07\/28\/new-york-city-bill-de-blasio-coronavirus-vaccine-mandate-unions\/\">issued a vaccine mandate<\/a> for all 400,000 public employees. Several unions quickly criticized the mandate and the New York Police Department\u2019s largest union even <a href=\"https:\/\/dailycaller.com\/2021\/08\/25\/new-york-police-department-nypd-union-vaccine-mandate-lawsuit-bill-de-blasio\/\">threatened<\/a> to sue. <strong><a href=\"https:\/\/dailycaller.com\/2021\/09\/09\/republican-states-legal-options-joe-biden-vaccine-mandate\/\">(RELATED: \u2018See You In Court\u2019: Republican States Say They Are Reviewing All Legal Options On Biden Vaccine Mandate)<\/a><\/strong><\/p>\n<p>\u201cMandates are not acceptable. People should have a choice,\u201d New York City Fire Department Emergency Medical Service Union President Oren Barzilay told the DCNF. \u201cThere are still many unknowns about this vaccine. (Spencer Platt\/Getty Images)<\/p>\n<\/div>\n<p>A Massachusetts police union, meanwhile, said dozens of state troopers have already resigned over a vaccine mandate requiring all state employees to get vaccinated, NPR <a href=\"https:\/\/www.npr.org\/sections\/coronavirus-live-updates\/2021\/09\/27\/1040961594\/massachusetts-state-police-resign-covid-vaccine\">reported<\/a> Monday. The mandate, <a href=\"https:\/\/www.mass.gov\/news\/baker-polito-administration-announces-covid-19-vaccine-requirement-for-executive-department-employees\" target=\"_blank\" rel=\"noopener noreferrer\">imposed<\/a> by Republican Gov. Charlie Baker last month, said state workers who refused vaccination would be fired.<\/p>\n<p>In San Diego, roughly 45% of police officers said they would prefer to be fired than comply with a city mandate to receive a vaccine, according to a San Diego Police Officers Association internal survey, the ABC affiliate KGTV <a href=\"https:\/\/www.10news.com\/news\/local-news\/san-diego-news\/san-diego-police-officers-association-survey-majority-of-respondents-against-vaccine-mandate\">reported<\/a>. The Portland police union <a href=\"https:\/\/katu.com\/news\/local\/labor-unions-representing-portland-employees-oppose-vaccine-mandate\">said<\/a> it opposed a vaccine mandate, citing potential resignations.<\/p>\n<p>But the&nbsp;American Federation of Labor and Congress of Industrial Organizations (AFL-CIO), a federation of 55 unions and 12.5 million total members, applauded the national mandate announced by Biden.<\/p>\n<p>\u201cThe resurgence of COVID-19 requires swift and immediate action, and we commend President Biden for taking additional steps to help put an end to this crisis,\u201d AFL-CIO President Liz Shuler said in a <a href=\"https:\/\/aflcio.org\/press\/releases\/strong-measures-needed-combat-surging-covid-19-pandemic\">statement<\/a> on Sept. 10. \u201cEveryone should be vaccinated\u2014as one step in stopping the pandemic.\u201d<\/p>\n<p>Many <a href=\"https:\/\/www.king5.com\/article\/news\/local\/seattle-tentative-agreements-city-unions-covid-vaccine-mandate-coronavirus-pandemic\/281-86c0c58f-34fa-43c1-b05f-ae684428952b\">labor unions<\/a> nationwide have also <a href=\"https:\/\/www.cnbc.com\/2021\/08\/23\/disney-world-to-require-covid-19-vaccinations-for-unionized-employees-.html\">reached<\/a> <a href=\"https:\/\/www.nbcchicago.com\/news\/coronavirus\/state-union-reaches-agreement-with-pritzker-admin-on-covid-vaccine-requirements\/2617720\/\">agreements<\/a> with officials on the terms for local mandates.<\/p>\n<p>Others, like the American Postal Workers Union (APWU), wouldn\u2019t speculate on the national mandate until they examined the published OSHA rule. <strong><a href=\"https:\/\/dailycaller.com\/2021\/09\/17\/republican-states-fighting-back-against-bidens-vaccine-mandate\/\">(RELATED: The States That Have Fought Back Against Biden\u2019s Vaccine Mandate)<\/a><\/strong><\/p>\n<p>\u201cAs the APWU has continually stated, all employees are encouraged to wear face coverings at work and are encouraged to voluntarily receive one of the COVID-19 vaccines,\u201d the APWU said in a <a href=\"https:\/\/www.apwu.org\/news\/vaccination-mandates-president-biden\">statement<\/a>.<\/p>\n<p>The union wouldn\u2019t speculate about mass resignations, but noted that the U.S. Postal Service has been hiring, which could offset any departures, APWU spokesperson Jamie Horowitz said in a brief phone interview.<\/p>\n<div id=\"attachment_7291212\" class=\"wp-caption alignnone\" readability=\"35\"><img decoding=\"async\" aria-describedby=\"caption-attachment-7291212\" loading=\"lazy\" class=\"size-full wp-image-7291212\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/09\/GettyImages-1229170550-scaled-1.jpg\" alt=\"A postal worker carries a bin with election ballots in Miami, Florida on Oct. 19, 2020. While small business groups opposed the rule, big business rallied behind it.<\/p>\n<p>\u201cPresident Biden calls his plan a \u2018path out of the pandemic\u2019 but this mandate on business is a path to confusion, vastly higher costs, new liabilities, and general workplace chaos for businesses,\u201d Small Business &amp; Entrepreneurship Council President Karen Kerrigan <a href=\"https:\/\/sbecouncil.org\/2021\/09\/09\/statement-on-presidents-vaccine-and-testing-mandate-for-business\/\">said<\/a>. \u201cThe restrictive one-size-fits all requirement will hamstring the flexibility business owners need \u2013 and are using \u2013 to adapt to the ever-changing nature of the pandemic and its variants.\u201d<\/p>\n<p>The National Federation of Independent Business (NFIB), the leading small business group in the country, <a href=\"https:\/\/assets.nfib.com\/nfibcom\/NFIB-Letter-David-Addington-9.15.21.pdf\">wrote a letter<\/a> to Labor Secretary Marty Walsh slamming the mandate and arguing it is likely illegal. The group said that a mandate should be implemented by Congress, not the White House.<\/p>\n<p>\u201cNFIB recognizes the duty of governments to help protect the safety and health of the people, but NFIB also recognizes the duty of governments to help preserve the liberties of the people, even in difficult situations,\u201d NFIB Senior Vice President and General Counsel David Addington wrote in the letter. <strong><a href=\"https:\/\/dailycaller.com\/2021\/09\/14\/joe-biden-coronavirus-vaccine-mandate-arizona-mark-brnovich\/\">(RELATED: Arizona Becomes First State To Sue Biden Over Vaccine Mandates)<\/a><\/strong><\/p>\n<p>The Job Creators Network, another association of small businesses, <a href=\"https:\/\/www.jobcreatorsnetwork.com\/press_releases\/jcn-calls-on-president-biden-to-immediately-rescind-vaccine-mandate-on-businesses\/\" target=\"_blank\" rel=\"noopener noreferrer\">characterized<\/a> the mandate as an \u201conerous regulation\u201d and implored the administration to reverse it. (Tasos Katopodis\/Getty Images for Care Can\u2019t Wait)<\/p>\n<\/div>\n<p>However, the Business Roundtable, a large coalition of Fortune 500 executives, <a href=\"https:\/\/dailycaller.com\/2021\/09\/10\/big-business-groups-joe-biden-vaccine-mandate-coronavirus\/\">applauded<\/a> Biden\u2019s mandate. The group \u2013 which includes Amazon CEO Andy Jassy, Google CEO Sundar Pichai and Apple CEO Tim Cook among others \u2013 said many of its members had already implemented the mandate.<\/p>\n<p>\u201cBusiness Roundtable welcomes the Biden Administration\u2019s continued vigilance in the fight against COVID,\u201d Business Roundtable President &amp; CEO Joshua Bolten said in a <a href=\"https:\/\/www.businessroundtable.org\/business-roundtable-statement-on-white-house-covid-19-vaccination-testing-announcement\">statement<\/a>. \u201cAmerica\u2019s business leaders know how critical vaccination and testing are in defeating the pandemic, which is why so many have invested resources in encouraging and incentivizing their customers and employees to get vaccinated, including providing paid time off.\u201d<\/p>\n<p>\u201cOver the past several weeks many companies have decided to implement a vaccine mandate for some or all of their employees, a decision we applaud,\u201d Bolten continued.<\/p>\n<p>The Chamber of Commerce, the largest business group in the U.S., said it would help its members follow the mandate. <strong><a href=\"https:\/\/dailycaller.com\/2021\/09\/27\/medical-experts-joe-biden-vaccine-covid-19-goal\/\">(RELATED: Medical Experts Are Unsure Why Biden Thinks 98% Of Americans Need To Be Vaccinated)<\/a><\/strong><\/p>\n<p>\u201cThe Chamber will carefully review the details of the executive orders and associated regulations and will work to ensure that employers have the resources, guidance, and flexibility necessary to ensure the safety of their employees and customers and comply with public health requirements,\u201d a U.S. Chamber spokesperson told the Daily Caller News Foundation in a statement.<\/p>\n<div id=\"attachment_7291209\" class=\"wp-caption alignnone\" readability=\"33\"><img decoding=\"async\" aria-describedby=\"caption-attachment-7291209\" loading=\"lazy\" class=\"size-full wp-image-7291209\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/09\/GettyImages-1234732631-scaled-1.jpg\" alt=\"A woman waits to go in a restaurant in New York City on Aug. 17.
