Under the code, the individuals cannot be freed until it is determined whether they are actually admitted into the nation, according to Fox News. For individuals claiming asylum they, too, must first receive a determination from a judge as to whether they are entitled to asylum before they are released, according to the report.<\/p>\n<p>The exception to the rule gives the federal government \u201cparole authority,\u201d which allows illegal immigrants to be immediately released throughout the nation solely on a case-by-case basis for \u201curgent humanitarian reasons or significant public benefit.\u201d<\/p>\n<p>\u201cThe government is not free to ignore the clear commands of Congress,\u201d the lawsuit reportedly alleges. \u201cIt has claimed that it lacks the resources and detention capacity to process the surge of migrants at the border.\u201d<\/p>\n<p>\u201cOnce people are released into the interior, the federal government may never find them,\u201d Moody\u2019s office reportedly said. The suit also alleges the administration \u201csought to eliminate measures that increase its resources and detention capacity,\u201d such as the&nbsp;so-called \u2018Remain in Mexico\u2019 policy, according to Fox News.<\/p>\n<p>The suit asks the court to \u201chold unlawful and set aside\u201d the administration\u2019s policy of \u201creleasing arriving aliens subject to mandatory detention, of paroling aliens without engaging in case-by-case adjudication or abiding by the other limits on that authority; and of failing to serve charging documents or initiate removal proceedings against plainly inadmissible aliens who are being released into the interior of the United States.\u201d<\/p>\n<p>The suit was filed in the Pensacola Division of the Northern District of Florida and the Department of Homeland Security (DHS), Immigrations and Customs Enforcement (ICE), DHS Sec. Alejandro Mayorkas, other top immigration officials and U.S. Citizenship and Immigration Services are listed as defendants, according to Fox News.<\/p>\n<p>Moody had previously <a href=\"https:\/\/dailycaller.com\/2021\/03\/09\/florida-attorney-general-ashley-moody-sues-biden-immigration-policies\/\" target=\"_blank\" rel=\"noopener noreferrer\">sued<\/a> the administration in March over Biden\u2019s \u201creckless\u201d immigration policies.<\/p>\n<p>Mayorkas <a href=\"https:\/\/dailycaller.com\/2021\/09\/26\/mass-catch-release-continues-mayorkas-confirms-thousands-released-us-many-not-tested-covid\/\" target=\"_blank\" rel=\"noopener noreferrer\">confirmed<\/a> Sunday that at least 12,000 Haitian migrants who are illegally in the U.S. were released into the states from Del Rio, Texas. <strong><a href=\"https:\/\/dailycaller.com\/2021\/09\/26\/chris-wallace-confronts-mayorkas-on-flood-migrants-border\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: \u2018Why Didn\u2019t You Build, Forgive Me, A Wall?\u2019: Chris Wallace Confronts Mayorkas On \u2018Flood\u2019 Of Migrants At The Border)<\/a><\/strong><\/p>\n<p>Mayorkas admitted the number could be even \u201chigher\u201d than his initial estimation but migrants are \u201cmonitored\u201d by the department to \u201censure their appearance in court as the law requires.\u201d<\/p>\n<p>Mayorkas <a href=\"https:\/\/dailycaller.com\/2021\/09\/24\/around-12400-migrants-are-waiting-to-see-whether-theyll-be-allowed-to-remain-in-us\/\" target=\"_blank\" rel=\"noopener noreferrer\">said<\/a> during a recent press conference roughly 12,400 Haitian migrants would have their cases heard by a judge rather than being immediately expelled under Title 42. Title 42 is a Trump-era public health order that expels most migrants from the U.S. If a migrant is determined to need immediate medical attention or state an asylum claim they aren\u2019t subject to removal. If a judge determines a migrant doesn\u2019t have a valid asylum claim they will be expelled.<\/p>\n<p>Mayorkas said the reason why roughly 30,000 Haitian migrants who have crossed the border into Del Rio over recent weeks haven\u2019t been stopped is that \u201cwe surged our resources, we surged our personnel.\u201d<\/p>\n<p>Several migrants who made it past border patrol were <a href=\"https:\/\/dailycaller.com\/2021\/09\/24\/haitian-migrants-del-rio-crisis-texas-border-psaki-approval-rating-exclusive-footage\/\" target=\"_blank\" rel=\"noopener noreferrer\">captured on video<\/a> obtained exclusively by the Daily Caller\u2019s Jorge Ventura sleeping outside the Del Rio airport awaiting flights to Florida.
