Tommy Hanes, a Republican sponsor of the bill, told The Epoch Times that it has garnered media attention following <a href=\"https:\/\/www.theepochtimes.com\/t-joe-biden\">President Joe Biden\u2019s<\/a>&nbsp;Sept. 10 speech that announced new federal <a href=\"https:\/\/www.theepochtimes.com\/federal-workers-sue-biden-admin-over-covid-19-vaccination-mandates_4014626.html\">vaccine requirements<\/a>.<\/p>\n<p>Part of Biden\u2019s requirements is mandating private companies with 100 or more employees to have staff vaccinated or tested&nbsp;weekly for the <a href=\"https:\/\/www.theepochtimes.com\/giving-the-right-name-to-the-virus-causing-a-worldwide-pandemic-2_3277200.html\">CCP (Chinese Communist Party) virus<\/a>, commonly known as the novel coronavirus, the pathogen that causes COVID-19<\/p>\n<p>After Biden\u2019s speech, Hanes said he now plans to revise the bill or draft a new version with a clause that protects the employer as well.<\/p>\n<p>If the current bill were to pass, it would put the employer in the position of consequentially violating federal law by adhering to state law.<\/p>\n<p>The bill states that an employee and his or her dependents have \u201cprivate right-of-action against an employer for any adverse reaction, injury, temporary or permanent disability, or death\u201d as a result of the <a href=\"https:\/\/www.theepochtimes.com\/t-covid-19\">COVID-19<\/a> vaccine mandated by the employer.<\/p>\n<p>What prompted the idea for the bill, Hanes said, was hearing a legal opinion claiming that, because Alabama is an \u201cat-will\u201d state, the employer can mandate vaccines for the employee. An at-will state means an employer can fire an employee at any time.<\/p>\n<p>\u201cThis bill is about individual liberties,\u201d Hanes said. \u201cEven though we are an at-will state, that only goes so far. It doesn\u2019t mean the employer owns you.\u201d<\/p>\n<p>The premise of a vaccine mandate, Hanes said, is based on a notion of ownership.<\/p>\n<p>\u201cIt\u2019s like my dog: if my dog could talk and say, \u2018no, I don\u2019t want the rabies vaccine,\u2019 well, she doesn\u2019t have anything to say about that because I own her,\u201d Hanes said.<\/p>\n<p>An employee, Hanes said, is an individual business.<\/p>\n<p>\u201cEmployees sell their time and labor to that employer because they need to purchase that from them,\u201d Hanes said. \u201cEmployees really work for themselves. Once a man or a woman gives a fair day\u2019s work for a fair day\u2019s wage, then they have fulfilled their end of the bargain.\u201d<\/p>\n<p>On Biden\u2019s vaccine mandate speech, Hanes referred to the balance of power between the federal government and the states.<\/p>\n<p>\u201cThe federal government was created by the states, with limited power,\u201d Hanes said. \u201cFederal law doesn\u2019t always supersede state law.\u201d<\/p>\n<p>He added that the Tenth Amendment and the Anti-Commandeering Doctrine were established to limit federal overreach, which has been the winning argument in several cases in the U.S. Supreme Court that have overturned federal law \u201con numerous occasions.\u201d<\/p>\n<p>\u201cI\u2019m sure if this bill were to pass, the federal government would take the state of Alabama to court, but some things are just worth fighting for,\u201d Hanes said. \u201cIndividual liberties are worth fighting for.\u201d<\/p>\n<p>Alabama is one of 27 states with Republican governors or attorney generals who have stated that they will fight Biden\u2019s executive order.<\/p>\n<p>In a statement on the mandate, Alabama Attorney General Steve Marshall said the state of Alabama will sue to block the order.<\/p>\n<p>\u201cThe vaccine mandate is unprecedented in its audacity and unlawful in its application,\u201d Marshall said. \u201cThe Biden administration knows this full and well.\u201d<\/p>\n<div class=\"one_author_block round\" readability=\"7\">\n<div class=\"top_row\">\n\t\t\t\t\t<img decoding=\"async\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2021\/08\/Matt.jpeg\" alt=\"Matt McGregor\" \/><\/p>\n<div class=\"names\">\n<p>Matt McGregor<\/p>\n<p>Reporter<\/p>\n<\/div>\n<p>Follow<\/p>\n<\/div>\n<p>Matt McGregor covers news from North and South Carolina for The Epoch Times.\n<\/p>\n<\/p><\/div>\n","protected":false},"excerpt":{"rendered":"<p>If an individual was injured by an employer-mandated COVID-19 vaccine, a proposed Alabama bill will give the employee the right to take legal action against their employer.
