Pfizer and Moderna, which already have vaccine requirements for their U.S. employees, will likely be subject to Biden\u2019s mandate that companies with 100 or more employees require COVID-19 vaccination or weekly testing.<\/p>\n<p><span><strong>Fact Check:&nbsp;<\/strong><\/span><\/p>\n<p>Biden on Sept. 9 announced a vaccine rule that mandates companies with 100 or more employees to require their staff to either be vaccinated against COVID-19 or tested for it on a weekly basis, according to the <a href=\"https:\/\/apnews.com\/article\/joe-biden-business-health-coronavirus-pandemic-executive-branch-18fb12993f05be13bf760946a6fb89be\" target=\"_blank\" rel=\"noopener noreferrer\">Associated Press<\/a>. The same day, he issued an <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/presidential-actions\/2021\/09\/09\/executive-order-on-requiring-coronavirus-disease-2019-vaccination-for-federal-employees\/\" target=\"_blank\" rel=\"noopener noreferrer\">executive order<\/a> mandating all federal employees of the executive branch be vaccinated against COVID-19.<\/p>\n<p>Since then, a graphic <a href=\"https:\/\/www.instagram.com\/p\/CUCAJKMr124\/\" target=\"_blank\" rel=\"noopener noreferrer\">alleging<\/a> certain groups of people are exempt from Biden\u2019s vaccine mandates has been circulating on Instagram. The graphic reads, \u201cExempt from Biden\u2019s V mandate: White House Staff, CDC + FDA employees, Moderna + Pfizer employees, Congressional staff, illegal aliens.\u201d <strong><a href=\"https:\/\/checkyourfact.com\/2021\/05\/03\/fact-check-fda-not-authorize-approve-covid-19-vaccine\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Will The FDA Not Authorize Or Approve Any COVID-19 Vaccine?)<\/a><\/strong><\/p>\n<p>The <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/presidential-actions\/2021\/09\/09\/executive-order-on-requiring-coronavirus-disease-2019-vaccination-for-federal-employees\/\" target=\"_blank\" rel=\"noopener noreferrer\">vaccine-related executive order<\/a> Biden signed mandates \u201ceach agency shall implement, to the extent consistent with applicable law, a program to require COVID-19 vaccination for all of its Federal employees, with exceptions only as required by law.\u201d It defines an agency as an \u201cexecutive agency as defined in 5 U.S.C. 105 (excluding the Government Accountability Office).\u201d<\/p>\n<p>Biden\u2019s COVID-19 Action Plan, which <a href=\"https:\/\/www.whitehouse.gov\/covidplan\/\" target=\"_blank\" rel=\"noopener noreferrer\">can be found<\/a> on the White House website, states the executive order requires \u201call federal executive branch workers to be vaccinated.\u201d White House staff are employees <a href=\"https:\/\/www.usa.gov\/branches-of-government\" target=\"_blank\" rel=\"noopener noreferrer\">within the executive branch<\/a>, meaning they are subject to the COVID-19 vaccine mandate outlined in Biden\u2019s executive order, aside from exceptions required by law.&nbsp;There is no option for weekly testing in the executive order.<\/p>\n<p><a href=\"https:\/\/www.cdc.gov\/about\/organization\/cio.htm\" target=\"_blank\" rel=\"noopener noreferrer\">CDC<\/a> and <a href=\"https:\/\/www.fda.gov\/about-fda\/fda-organization\" target=\"_blank\" rel=\"noopener noreferrer\">FDA<\/a> employees are also considered part of the <a href=\"https:\/\/www.hhs.gov\/about\/historical-highlights\/index.html\" target=\"_blank\" rel=\"noopener noreferrer\">executive<\/a> <a href=\"https:\/\/www.hhs.gov\/about\/historical-highlights\/index.html\" target=\"_blank\" rel=\"noopener noreferrer\">branch<\/a> and, thus, are subject to the executive order, as both agencies fall under the <a href=\"https:\/\/www.hhs.gov\/about\/agencies\/hhs-agencies-and-offices\/index.html\" target=\"_blank\" rel=\"noopener noreferrer\">Department of Health and Human Services<\/a> (HHS). An Office of Management and Budget official confirmed in an email to Check Your Fact that the CDC and FDA are subject to the mandate.<\/p>\n<p>Congressional staffers, on the other hand, are not subject to Biden\u2019s Sept. 9 executive order due to the <a href=\"https:\/\/www.house.gov\/the-house-explained\/branches-of-government\" target=\"_blank\" rel=\"noopener noreferrer\">separation of powers<\/a> among the federal government\u2019s three branches, according to <a href=\"https:\/\/www.newsweek.com\/members-congress-staff-exempt-biden-covid-vaccine-mandate-1627859\" target=\"_blank\" rel=\"noopener noreferrer\">Newsweek<\/a>. The two bodies of Congress and their staff are part of the <a href=\"https:\/\/www.visitthecapitol.gov\/about-congress\/two-bodies-one-branch#:~:text=Congress%20is%20divided%20into%20two,special%20constitutional%20duties%20and%20powers.\" target=\"_blank\" rel=\"noopener noreferrer\">legislative branch<\/a>.<\/p>\n<p>While Biden\u2019s executive order does not apply to Pfizer and Moderna, it\u2019s likely the two pharmaceutical companies will be subject to the president\u2019s mandate for employers with 100 or more employees to require their workers to either get vaccinated or submit to weekly testing. Pfizer had, according to <a href=\"https:\/\/www.reuters.com\/business\/healthcare-pharmaceuticals\/pfizer-require-us-workers-receive-covid-19-vaccine-or-regular-tests-2021-08-04\/\" target=\"_blank\" rel=\"noopener noreferrer\">Reuters<\/a>, about 29,400 U.S.-based employees at the end of 2020, and Moderna had about 1,500 employees at the end of March, according to a <a href=\"https:\/\/investors.modernatx.com\/news-releases\/news-release-details\/moderna-reaffirms-commitment-job-creation-massachusetts\" target=\"_blank\" rel=\"noopener noreferrer\">press release<\/a>. The mandate for companies will come in the form of an upcoming emergency temporary standard (ETS) from the <a href=\"https:\/\/apnews.com\/article\/joe-biden-business-health-coronavirus-pandemic-henry-mcmaster-f33acd986ad5045e48088a832c6f9903\" target=\"_blank\" rel=\"noopener noreferrer\">Occupational Safety and Health Administration<\/a> (OSHA), according to the <a href=\"https:\/\/www.whitehouse.gov\/covidplan\/\" target=\"_blank\" rel=\"noopener noreferrer\">White House\u2019s COVID-19 Action Plan<\/a>.<\/p>\n<p>It\u2019s also worth noting that both companies had <a href=\"https:\/\/www.cnbc.com\/2021\/08\/04\/vaccine-mandate-pfizer-will-require-covid-shot-or-testing-for-us-employees-.html\" target=\"_blank\" rel=\"noopener noreferrer\">already<\/a> <a href=\"https:\/\/investors.modernatx.com\/news-releases\/news-release-details\/covid-19-vaccination-requirement-all-workers-us\" target=\"_blank\" rel=\"noopener noreferrer\">announced<\/a> COVID-19 vaccination-related policies for their U.S.-based employees prior to Biden announcing the future ETS from OSHA. Pfizer, for instance, announced Aug. 4 that it would start requiring its U.S. employees and contractors to get vaccinated or undergo weekly testing for the virus, <a href=\"https:\/\/www.cnbc.com\/2021\/08\/04\/vaccine-mandate-pfizer-will-require-covid-shot-or-testing-for-us-employees-.html\" target=\"_blank\" rel=\"noopener noreferrer\">CNBC<\/a> reported. Pfizer spokesperson Pam Eisele told Check Your Fact via email Wednesday that the company is \u201crequiring all U.S. colleagues and contractors to be fully vaccinated unless approved for a medical or religious accommodation from vaccination.\u201d<\/p>\n<p>On Aug. 20, Moderna said <a href=\"https:\/\/investors.modernatx.com\/news-releases\/news-release-details\/covid-19-vaccination-requirement-all-workers-us\" target=\"_blank\" rel=\"noopener noreferrer\">in press release<\/a> that it would \u201crequire COVID-19 vaccination for all workers in the United States, effective October 1, 2021\u201d and that \u201crequests for medical or religious exemptions will be considered on an individual basis.\u201d <strong><a href=\"https:\/\/checkyourfact.com\/2021\/09\/17\/fact-check-christine-grady-fauci-wife-acting-head-food-drug-administration\/\" target=\"_blank\" rel=\"noopener noreferrer\">(RELATED: Image Claims Christine Grady Is The Acting Head Of The FDA)<\/a><\/strong><\/p>\n<p>Biden\u2019s <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/presidential-actions\/2021\/09\/09\/executive-order-on-requiring-coronavirus-disease-2019-vaccination-for-federal-employees\/\" target=\"_blank\" rel=\"noopener noreferrer\">executive order<\/a> mandating COVID-19 vaccines does not mention immigrants living in or entering the country illegally, nor did <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/speeches-remarks\/2021\/09\/09\/remarks-by-president-biden-on-fighting-the-covid-19-pandemic-3\/\" target=\"_blank\" rel=\"noopener noreferrer\">his announcement<\/a> regarding the OSHA ETS.<\/p>\n<p>During a Sept. 10 press briefing, White House Press Secretary Jen Psaki <a href=\"https:\/\/www.foxnews.com\/politics\/psaki-stands-by-employer-vaccine-mandate-while-illegal-immigrants-remain-unvaccinated-thats-correct\" target=\"_blank\" rel=\"noopener noreferrer\">said<\/a>, \u201cThat\u2019s correct,\u201d in response to Fox News\u2019 Peter Doocy saying it\u2019s \u201cnot a requirement for migrants at the southern border\u201d to be vaccinated, according to <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/press-briefings\/2021\/09\/10\/press-briefing-by-press-secretary-jen-psaki-september-10-2021\/\" target=\"_blank\" rel=\"noopener noreferrer\">a transcript<\/a>.
