Here\u2019s why.\u201d<\/p>\n<p>\u201cNeither of these lawsuits are valid attempts to save innocent human lives,\u201d Texas Right to Life said in a press release. \u201cBoth cases are self-serving legal stunts, abusing the cause of action created in the Texas Heartbeat Act for their own purposes.\u201d<\/p>\n<p>The pro-life Texas group said that it believes Braid published his op-ed intending to draw \u201cimprudent lawsuits.\u201d <strong><a href=\"https:\/\/dailycaller.com\/2021\/09\/13\/hochul-new-york-facebook-censor-abortion-pro-life-misinformation\/\">(RELATED: New York Governor Asks Facebook To Censor Pro-Life \u2018Misinformation\u2019 About Abortion)<\/a><\/strong><\/p>\n<p>\u201cTexas Right to Life is dubious that Braid\u2019s op-ed is purely a legal and publicity ploy,\u201d Texas Right to Life continued. \u201cThe abortion industry\u2019s 16 previous efforts failed to stop this law from saving lives so far, and this may be another attempt. However, there is a four-year statute of limitations for any violations, and Texas Right to Life is dedicated to ensuring that the Texas Heartbeat Act is fully enforced.\u201d<\/p>\n<p><a href=\"https:\/\/dailycaller.com\/2021\/08\/23\/attorney-lawsuit-texas-abortion-law\/\">The Heartbeat Act<\/a>&nbsp;has particularly upset abortion advocates as it allows \u201cany person\u201d to sue doctors, abortion clinics, or anyone who \u201cknowingly engages in conduct that aids or abets the performance or inducement of an abortion.\u201d<\/p>\n<p>Those who sue over an abortion may be awarded $10,000 \u201cfor each abortion\u201d the defendant performed, induced, aided, or abetted in violation of the law.<\/p>\n<p>Stilley\u2019s complaint describes him as a \u201cdi<span class=\"l7\">sba<span class=\"l6\">rred and disg<span class=\"l9\">raced f<span class=\"l8\">ormer Arkansas lawyer\u201d currently on home confinement for tax evasion and conspiracy \u2014 charges he calls \u201cfraudulent.\u201d <\/span><\/span><\/span><\/span><\/p>\n<p><span class=\"l7\"><span class=\"l6\"><span class=\"l9\"><span class=\"l8\">Stilley, who requested the court to order Braid to pay him $100,000 but no less than the statutory minimum of $10,000, <a href=\"https:\/\/www.nytimes.com\/2021\/09\/20\/us\/texas-abortion-lawsuit-alan-braid.html\">told the New York Times<\/a> that he filed the lawsuit to test the new law\u2019s provisions.&nbsp;<\/span><\/span><\/span><\/span><\/p>\n<p>\u201cI\u2019m not pro-life,\u201d 58-year-old Stilley told the Times. \u201cThe thing that I\u2019m trying to vindicate here is the law. What\u2019s the law?\u201d<\/p>\n<p><a title=\"View Oscar Stilley Complaint Against Abortionist Alan Braid on Scribd\" href=\"https:\/\/www.scribd.com\/document\/526735224\/Oscar-Stilley-Complaint-Against-Abortionist-Alan-Braid#from_embed\">Oscar Stilley Complaint Aga\u2026<\/a> by <a title=\"View Mary Margaret Olohan&#039;s profile on Scribd\" href=\"https:\/\/www.scribd.com\/user\/506904746\/Mary-Margaret-Olohan#from_embed\">Mary Margaret Olohan<\/a><\/p>\n<p>Former attorney Gomez, who additionally sued Braid, was also disbarred and suspended indefinitely after fellow attorneys accused Gomez of sending threatening emails, <a href=\"https:\/\/www.ksat.com\/news\/local\/2021\/09\/20\/san-antonio-doctor-who-openly-flouted-texas-abortion-ban-sued-by-disbarred-illinois-lawyer\/\">according to the local outlet KSAT.com<\/a>.<\/p>\n<p>Gomez identified himself as a \u201cpro choice plaintiff\u201d and Illinois resident, according to the publication. His court filing asks the judge to order that Texas\u2019 Heartbeat Act violates Roe v. Wade.&nbsp;<strong><a href=\"https:\/\/dailycaller.com\/2021\/09\/14\/glenn-youngkin-pro-life-virginia-mcauliffe-washington-post-pinocchios\/\">(RELATED: Washington Post: Glenn Youngkin Isn\u2019t As Pro-Life As McAuliffe Claims)<\/a><\/strong><\/p>\n<div class=\"w-700 mr-auto-ns ml-auto-ns\" readability=\"19\">\n<div data-qa=\"drop-cap-letter\" readability=\"33\">\n<p class=\"font--article-body font-copy gray-darkest ma-0 pb-md\" data-el=\"text\">\u201cFor me, it is 1972 all over again,\u201d wrote abortionist Braid in his WaPo piece. \u201cAnd that is why, on the morning of Sept. 6, I provided an abortion to a woman who, though still in her first trimester, was beyond the state\u2019s new limit. I acted because I had a duty of care to this patient, as I do for all patients, and because she has a fundamental right to receive this care.\u201d<\/p>\n<p data-el=\"text\">Braid added that he fully understood the possibility of legal consequences but wanted to make sure \u201cTexas didn\u2019t get away with its bid to prevent this blatantly unconstitutional law from being tested.\u201d<\/p>\n<p data-el=\"text\">\u201cI understand that by providing an abortion beyond the new legal limit, I am taking a personal risk, but it\u2019s something I believe in strongly,\u201d he added. \u201cRepresented by the Center for Reproductive Rights, my clinics are among the plaintiffs in an ongoing federal lawsuit to stop S.B. 8.\u201d<\/p>\n<p data-el=\"text\">The Center for Reproductive Rights did not immediately respond to a request for comment about whether it is representing or offering legal advice to Braid.<\/p>\n<\/p><\/div>\n<\/p><\/div>\n<p>Content created by The Daily Caller News Foundation is available without charge to any eligible news publisher that can provide a large audience.
