Then the order could turn into a preliminary injunction. <a href=\"https:\/\/twitter.com\/news10nbc?ref_src=twsrc%5Etfw\">@news10nbc<\/a> <a href=\"https:\/\/t.co\/6XmDrymi5z\">pic.twitter.com\/6XmDrymi5z<\/a><\/p>\n<p>\u2014 Berkeley Brean (@whec_bbrean) <a href=\"https:\/\/twitter.com\/whec_bbrean\/status\/1440343521555140611?ref_src=twsrc%5Etfw\">September 21, 2021<\/a><\/p>\n<\/blockquote>\n<p>Last week, the U.S. District Court for the Northern District of New York <a href=\"https:\/\/www.dailywire.com\/news\/judge-blocks-vaccine-mandate-for-health-workers-in-new-york\">temporarily blocked<\/a> Hochul\u2019s order.<\/p>\n<p id=\"_ap_link_health care_Obamacare_\">As highlighted by <a href=\"https:\/\/www.dailywire.com\/news\/judge-blocks-vaccine-mandate-for-health-workers-in-new-york\">The Daily Wire<\/a>, a group of health care&nbsp;workers represented by the Thomas More Society sued the state arguing their Constitutional rights were violated when the state\u2019s issued a vaccination mandate barring religious exemptions.<\/p>\n<p id=\"_ap_link_health_Obamacare_\">Judge David Hurd last Tuesday issued the order giving the Hochul administration&nbsp;\u201cuntil Sept. 22 to respond to the lawsuit in federal court in Utica,\u201d ABC News <a href=\"https:\/\/abcnews.go.com\/Health\/wireStory\/judge-blocks-medical-worker-vaccine-mandate-ny-state-80014754\">reported<\/a>. \u201cIf the state opposes the plaintiffs\u2019 request for a preliminary court order blocking the vaccine mandate, a Sept. 28 oral hearing will occur.\u201d<\/p>\n<p>Now-resigned Governor Andrew Cuomo (D-NY) on&nbsp;August 16 announced that all healthcare workers in the state of New York, including staff at hospitals and long-term care facilities such as nursing homes, adult care facilities, and other congregate care settings, are required to be vaccinated against Covid-19.<\/p>\n<p>The Thomas More Society argued that the&nbsp;mandate \u201cattempts to nullify protections for sincere religious beliefs granted under Title VII of the Civil Rights Act of 1964, even though days earlier the state of New York had afforded protection for religious beliefs in its prior health order.\u201d<\/p>\n<p>Attorney Christopher Ferrara, Thomas More Society Special Counsel,&nbsp;called the move \u201ca&nbsp;brazen power grab by people who think they can get away with anything.\u201d<\/p>\n<p>\u201cWhat New York is attempting to do is slam shut an escape hatch from an unconstitutional vaccine mandate,\u201d Ferrara argued. \u201cAnd they are doing this while, knowing that many people have sincere religious objections to vaccines that were tested, developed, or produced with cell lines derived from aborted children.\u201d<\/p>\n<p>\u201cThese plaintiffs are not \u2013 I repeat \u2013 not anti-vaxxers, as the fake news media calls them,\u201d stressed Ferrara. \u201cThey are in fact in favor of voluntary vaccination with informed consent, but they oppose jack-booted coercion by the state to take a vaccine their religion forbids them to take. This is America, not Red China.\u201d<\/p>\n<p>\u201cWithout court intervention,\u201d Ferrara warned before Judge Hurd\u2019s order, \u201cthese health professionals face loss of occupation, professional status, and employability anywhere in the state of New York.
